The presiding judge examines the witness.
He shall subsequently grant the judges and the public prosecutor the opportunity to put questions to the witness.
He shall afford the suspect the opportunity to examine the witness and, in response thereto, to submit such arguments against the statement of that witness as may serve for his defence.
If, however, the witness has not yet been heard during the preliminary investigation and has been summoned at the request of the suspect or has appeared at the hearing, he shall be examined first by the suspect and subsequently by the presiding judge. The second paragraph shall apply.
The presiding judge shall afford the public prosecutor the opportunity to make observations regarding the examination referred to in the fourth paragraph.
De voorzitter ondervraagt de getuige.
Hij geeft daarna de rechters en de officier van justitie de gelegenheid tot het stellen van vragen aan de getuige.
Hij stelt de verdachte in de gelegenheid om de getuige te ondervragen en naar aanleiding daarvan tegen de verklaring van die getuige in te brengen wat tot zijn verdediging kan dienen.
Indien echter de getuige tijdens het voorbereidende onderzoek nog niet is gehoord en op verzoek van de verdachte is opgeroepen of ter terechtzitting verschenen, wordt hij eerst door de verdachte en daarna door de voorzitter ondervraagd. Het tweede lid is van toepassing.
De voorzitter stelt de officier van justitie in de gelegenheid tot het maken van opmerkingen over de ondervraging bedoeld in het vierde lid.
