Subject to seizure are all objects that may serve to bring the truth to light or to demonstrate unlawfully obtained advantage, as referred to in Article 36e of the Criminal Code.

Furthermore, all objects of which the forfeiture or the withdrawal from circulation may be ordered are subject to seizure.

Of the seizure of an object, a notice of seizure shall be drawn up by the investigating officer, even in cases where the authority to seize is vested in the examining magistrate or the public prosecutor. As far as possible, a receipt shall be issued to the person from whom an object has been seized. The investigating officer shall place the notice in the hands of the assistant public prosecutor as soon as possible in order to have it assessed whether the seizure must be maintained.

Vatbaar voor inbeslagneming zijn alle voorwerpen die kunnen dienen om de waarheid aan de dag te brengen of om wederrechtelijk verkregen voordeel, als bedoeld in artikel 36e van het Wetboek van Strafrecht, aan te tonen.

Voorts zijn vatbaar voor inbeslagneming alle voorwerpen welker verbeurdverklaring of onttrekking aan het verkeer kan worden bevolen.

Van de inbeslagneming van een voorwerp wordt, ook in geval de bevoegdheid tot inbeslagneming toekomt aan de rechter-commissaris of de officier van justitie, door de opsporingsambtenaar een kennisgeving van inbeslagneming opgemaakt. Zoveel mogelijk wordt aan degene bij wie een voorwerp is inbeslaggenomen, een bewijs van ontvangst afgegeven. De opsporingsambtenaar stelt de kennisgeving zo spoedig mogelijk in handen van de hulpofficier van justitie teneinde te doen beoordelen of het beslag moet worden gehandhaafd.
