Witnesses who, in their capacity as journalists or publicists in the context of news gathering, possess information regarding persons who have provided such information for the purpose of publication, may excuse themselves from answering questions concerning the source of that information.
The examining magistrate may dismiss the witness's plea, as referred to in the first paragraph, if he judges that leaving questions unanswered would cause disproportionately great harm to a more compelling public interest.
Getuigen die als journalist of publicist in het kader van nieuwsgaring, beschikken over gegevens van personen die deze gegevens ter openbaarmaking hebben verstrekt, kunnen zich verschonen van het beantwoorden van vragen over de herkomst van die gegevens.
De rechter-commissaris kan het beroep van de getuige, bedoeld in het eerste lid, afwijzen indien hij oordeelt dat bij het onbeantwoord blijven van vragen aan een zwaarder wegend maatschappelijk belang een onevenredig grote schade zou worden toegebracht.
