Without prejudice to the following articles of this Title, Articles 268 up to and including 314, 315 up to and including 353, and 356 up to and including 366a shall apply mutatis mutandis to the legal proceedings before the court of appeal, on the understanding that, by way of derogation from the second paragraph of Article 365a, supplementation shall also take place if the appeal in cassation has been lodged more than three months after the date of the judgment or if there is an appeal as referred to in Article 410a, first paragraph.
The court of appeal shall direct the investigation at the hearing to the objections raised by the defendant and the public prosecution service against the judgment rendered in the first instance, and to such other matters as may be necessary.
Articles 51a, 51aa, paragraph 1, 51ac, paragraphs 2 and 4 up to and including 6, 51b, 51c, 51ca, 51d and 51h, 258, paragraph 6, and 260, paragraphs 1 and 2, shall apply mutatis mutandis to the proceedings before the court of appeal.
Behoudens de volgende artikelen van deze titel, zijn de artikelen 268 tot en met 314, 315 tot en met 353 en 356 tot en met 366a op het rechtsgeding voor het gerechtshof van overeenkomstige toepassing, met dien verstande dat in afwijking van het tweede lid van artikel 365a aanvulling ook plaats vindt indien het cassatieberoep meer dan drie maanden na de dag van de uitspraak is ingesteld of sprake is van een hoger beroep als bedoeld in artikel 410a, eerste lid.
Het gerechtshof richt het onderzoek ter terechtzitting op de bezwaren die door de verdachte en het openbaar ministerie worden ingebracht tegen het vonnis, in eerste aanleg gewezen, en op hetgeen overigens nodig is.
De artikelen 51a, 51aa, eerste lid, 51ac, tweede en vierde tot en met zesde lid, 51b, 51c, 51ca, 51d en 51h, 258, zesde lid en 260, eerste en tweede lid, zijn op het rechtsgeding voor het gerechtshof van overeenkomstige toepassing.
