The public prosecutor may suspend the recognition and execution of the European Investigation Order if:
the interest of a criminal investigation pending in the Netherlands precludes the execution of the order;
the documents, objects or data to which the order relates are already being used in another judicial proceeding.
If the public prosecutor suspends the execution of the order, he shall notify the authorities of the issuing state thereof in writing without delay, stating the grounds and, if possible, the expected duration of the suspension.
As soon as the grounds for suspension have ceased to exist, the order shall be executed. The public prosecutor shall notify the authorities of the issuing Member State thereof in writing without delay.
De officier van justitie kan de erkenning en uitvoering van het Europees onderzoeksbevel opschorten, indien:
het belang van een in Nederland lopend strafrechtelijk onderzoek zich verzet tegen de uitvoering van het bevel;
de stukken, voorwerpen of gegevens waarop het bevel ziet reeds gebruikt worden in een andere gerechtelijke procedure.
Indien de officier van justitie de uitvoering van het bevel opschort, geeft hij hiervan onverwijld schriftelijk kennis aan de autoriteiten van de uitvaardigende staat, onder vermelding van de gronden en zo mogelijk van de verwachte duur van de opschorting.
Zodra de gronden voor opschorting zijn vervallen, wordt het bevel alsnog uitgevoerd. De officier van justitie stelt de autoriteiten van de uitvaardigende lidstaat hiervan onverwijld schriftelijk in kennis.
