Rules may be established by Order in Council regarding the provision of a state contribution towards the funding of the preparation and implementation of:
projects as referred to in Articles 77e and 77f, paragraph 1, under b, of the Criminal Code,
community service orders as referred to in Article 77h, paragraph 2, of the Criminal Code, and
measures concerning the conduct of the juvenile as referred to in Article 77h, paragraph 4, under b of the Criminal Code.
Further rules regarding the provisions of this Title shall be laid down by or pursuant to an Order in Council. These further rules shall in any event concern:
the content of the community service order, the execution of the community service order, and the rights and obligations of the person sentenced to a community service order. In this regard, a deviation may be made from the number of hours that an educational project may last, as referred to in Article 77m, paragraph 4, of the Criminal Code, if the nature of the educational project gives cause to do so.
the requirements with which the plan, the programmes, and the institutions or organisations charged with the preparation and support of the measure must comply in the implementation of the measure concerning the conduct of the juvenile, as well as the working methods of these institutions or organisations.
the execution of a sentence or measure of which the court has ordered that it shall not be executed, in whole or in part.
Bij algemene maatregel van bestuur kunnen regels worden gesteld voor de verstrekking van rijkswege van een bijdrage in de bekostiging van de voorbereiding en uitvoering van:
projecten als bedoeld in de artikelen 77e en 77f, eerste lid, onder b, van het Wetboek van Strafrecht,
taakstraffen als bedoeld in artikel 77h, tweede lid, van het Wetboek van Strafrecht, en
maatregelen betreffende het gedrag van de jeugdige als bedoeld in artikel 77h, vierde lid, onderdeel b van het Wetboek van Strafrecht.
Bij of krachtens algemene maatregel van bestuur worden nadere regels gesteld over het bepaalde in deze titel. Deze nadere regels zien in elk geval op:
de inhoud van de taakstraf, de tenuitvoerlegging van de taakstraf en de rechten en plichten van de tot een taakstraf veroordeelde. Daarbij kan van het aantal uren dat een leerproject kan duren, genoemd in artikel 77m, vierde lid, van het Wetboek van Strafrecht worden afgeweken indien de aard van het leerproject daartoe aanleiding geeft.
de eisen waaraan bij de tenuitvoerlegging van de maatregel betreffende het gedrag van de jeugdige het plan, de programma’s en de instellingen of organisaties belast met de voorbereiding en de ondersteuning van de maatregel moeten voldoen, alsmede op de werkwijze van deze instellingen of organisaties.
de tenuitvoerlegging van een straf of maatregel waarvan de rechter heeft gelast dat deze geheel of gedeeltelijk niet ten uitvoer wordt gelegd.
