The public prosecutor to whom the petition for criminal prosecution has been submitted in accordance with the provisions of Article 5.3.8 shall submit his advice in this matter to Our Minister of Security and Justice.
The person to whom the petition relates shall be heard by the public prosecutor in that regard, or at least be duly summoned for that purpose, if the petition is based on a treaty and the jurisdiction to prosecute follows from that treaty for the Netherlands. Article 273, paragraph 1, shall apply mutatis mutandis.
De officier van justitie aan wie het verzoek tot strafvervolging overeenkomstig het bepaalde in artikel 5.3.8 is toegezonden brengt zijn advies terzake ter kennis van Onze Minister van Veiligheid en Justitie.
Degene op wie het verzoek betrekking heeft wordt daaromtrent door de officier van justitie gehoord, althans daartoe behoorlijk opgeroepen, indien het verzoek op een verdrag is gegrond en de bevoegdheid tot strafvervolging voor Nederland uit dat verdrag volgt. Artikel 273, eerste lid, is van overeenkomstige toepassing.
