In order to be entitled to a refund in the Member State of refund, the entrepreneur established in the Netherlands shall perform transactions that give rise to a right of deduction in the Netherlands.
Where the entrepreneur not established in the Member State of refund is established in the Netherlands, and performs both transactions that give rise to a right of deduction in the Netherlands and transactions that do not give rise to a right of deduction in the Netherlands, the Member State of refund may only take into account that portion of the tax eligible for refund in accordance with Article 33a that can be attributed to the former transactions in accordance with Article 173 of the VAT Directive 2006, as applied by the Netherlands.
Om in de lidstaat van teruggaaf recht te hebben op teruggaaf verricht de in Nederland gevestigde ondernemer handelingen die in Nederland een recht op aftrek doen ontstaan.
Wanneer de niet in de lidstaat van teruggaaf gevestigde ondernemer in Nederland gevestigd is, en zowel handelingen verricht die in Nederland een recht op aftrek doen ontstaan, als handelingen die in Nederland geen recht op aftrek doen ontstaan, kan van het overeenkomstig artikel 33a voor teruggaaf in aanmerking komende bedrag slechts dat gedeelte van de belasting door de lidstaat van teruggaaf in aanmerking worden genomen dat overeenkomstig artikel 173 van BTW-richtlijn 2006, zoals toegepast door Nederland, aan eerstgenoemde handelingen kan worden toegerekend.
