Any communication to the public and making available to the public of material protected under this Act in:
radio programmes;
television programmes which:
concern news and current affairs programmes; or
be fully financed by the broadcasting organization as referred to in Article 1.1 of the Media Act;
by means of a supporting online service that is carried out under the supervision and responsibility of the broadcasting organization, as well as the reproduction that is necessary for the provision of this service or for access to or the use of this service, shall be deemed to take place solely in the Netherlands if the broadcasting organization has its principal place of business there. The foregoing does not apply to television broadcasts of sporting events and the material contained therein protected under this Act.
Article 47c, paragraphs 2 and 3, of the Copyright Act shall apply mutatis mutandis.
Iedere mededeling aan het publiek en beschikbaarstelling voor het publiek van op grond van deze wet beschermd materiaal in:
radioprogramma’s;
televisieprogramma’s die:
nieuws- en actualiteitenprogramma’s betreffen; of
volledig door de omroeporganisatie, bedoeld in artikel 1.1. van de Mediawet, gefinancierd zijn;
door middel van een ondersteunende onlinedienst die onder toezicht en verantwoordelijkheid van de omroeporganisatie wordt uitgevoerd, alsmede de reproductie die noodzakelijk is voor het aanbieden van deze dienst of voor de toegang tot of het gebruik van deze dienst, wordt geacht enkel plaats te vinden in Nederland, indien de omroeporganisatie hier haar hoofdvestiging heeft. Het vorenstaande is niet van toepassing op televisie-uitzendingen van sportevenementen en de daarin vervatte op grond van deze wet beschermd materiaal.
Artikel 47c, tweede lid en derde lid, van de Auteurswet is van overeenkomstige toepassing.
