Where a broadcasting organisation transmits the programme-carrying signals directly to the party that provides for the transmission of material protected under this Act via cable or by other means, without the broadcasting organisation itself simultaneously broadcasting the signals, this constitutes a single communication to the public of material protected under this Act included in a radio or television programme, for which the broadcasting organisation and the party transmitting the programme-carrying signals are each responsible for their own contribution to that communication to the public.
Wanneer een omroeporganisatie de programmadragende signalen rechtstreeks aanlevert bij degene die de uitzending van op grond van deze wet beschermd materiaal via de kabel of langs andere weg verzorgt zonder dat de omroeporganisatie de signalen zelf gelijktijdig uitzendt, is er sprake van een enkele mededeling aan het publiek van in een radio of televisieprogramma opgenomen op grond van deze wet beschermd materiaal waarvoor de omroeporganisatie en degene die de programmadragende signalen uitzendt ieder voor zijn eigen bijdrage aan die mededeling aan het publiek verantwoordelijk is.
