Approval shall be granted by the Netherlands Vehicle Authority (Dienst Wegverkeer) upon application and against payment of the fee determined by said authority in the manner established by it, if the modification made complies, upon an inspection carried out by said authority, with the requirements set for this approval pursuant to an EU regulation in connection with the approval of motor vehicles or pursuant to the requirements established for this approval in Chapter III and Chapter V. The inspection may also include those parts of the vehicle for which the modification made has consequences.
By ministerial regulation, rules may be established regarding the making available of the vehicle by the applicant for the inspection, the submission of documents and the provision of information by the applicant in respect of the inspection, as well as regarding the manner in which the inspection is conducted.
By way of derogation from the first paragraph, approval for a modification in the construction or equipment shall be granted by the Netherlands Vehicle Authority (Dienst Wegverkeer) if it is guaranteed by an authorised holder of recognition that the modification made complies with the requirements established for this approval pursuant to Chapter III and Chapter V.
Goedkeuring wordt op aanvraag en tegen betaling op door de Dienst Wegverkeer vastgestelde wijze, van het daarvoor door deze dienst vastgestelde tarief door deze dienst verleend, indien de aangebrachte wijziging bij een door deze dienst verrichte keuring voldoet aan de voor deze goedkeuring gestelde eisen ingevolge een EU-verordening in verband met de goedkeuring van motorvoertuigen of ingevolge de in hoofdstuk III en hoofdstuk V voor deze goedkeuring vastgestelde eisen. De keuring kan mede omvatten die delen van het voertuig waarvoor de aangebrachte wijziging gevolgen heeft.
Bij ministeriële regeling kunnen regels worden vastgesteld betreffende het door de aanvrager voor de keuring ter beschikking stellen van het voertuig, het door de aanvrager overleggen van bescheiden en verstrekken van inlichtingen ter zake van de keuring alsmede betreffende de wijze waarop de keuring wordt verricht.
In afwijking van het eerste lid wordt door de Dienst Wegverkeer de goedkeuring voor een wijziging in de bouw of inrichting verleend indien door een daartoe gerechtigde erkenninghouder wordt gewaarborgd dat de aangebrachte wijziging voldoet aan de ingevolge hoofdstuk III en hoofdstuk V voor deze goedkeuring vastgestelde eisen.
