The residence permit, which entails lawful residence by operation of law, shall be granted with effect from the day on which the foreign national has demonstrated that he meets all conditions, but no earlier than with effect from the day on which the application was received.
The period of validity of the temporary residence permit as referred to in Article 14 shall be extended with effect from the day on which the foreign national has demonstrated that he meets all conditions, but no earlier than with effect from the day following that on which the period of validity of the residence permit for which extension was requested expires.
If the foreign national has not submitted the application for extension, or the data demonstrating that the conditions are met, in a timely manner and this cannot be attributed to him, the residence permit may be extended with effect from the day following that on which the period of validity of the residence permit for which extension was requested expires.
De verblijfsvergunning, die van rechtswege rechtmatig verblijf inhoudt, wordt verleend met ingang van de dag waarop de vreemdeling heeft aangetoond dat hij aan alle voorwaarden voldoet, maar niet eerder dan met ingang van de dag waarop de aanvraag is ontvangen.
De geldigheidsduur van de verblijfsvergunning voor bepaalde tijd als bedoeld in artikel 14 wordt verlengd met ingang van de dag waarop de vreemdeling heeft aangetoond dat hij aan alle voorwaarden voldoet, maar niet eerder dan met ingang van de dag na die waarop de geldigheidsduur van de verblijfsvergunning waarvoor verlenging is gevraagd afloopt.

By decision of 17 June 2021, the State Secretary for Justice and Security revoked the temporary regular residence permit granted to the foreign national. He also rejected an application to grant her an EU long-term resident's residence permit or a permanent regular residence permit.

The foreign national is from Iraq. Her fixed-term ordinary residence permit for the purpose of stay with her partner expired on 5 November 2020. On 13 January 2021, she submitted a petition for the extension of the period of validity of that residence permit. The State Secretary subsequently extended the period of validity of the residence permit with 13 January 2021 as the effective date. As a result, the foreign national's right of residence was interrupted and a so-called residence gap (verblijfsgat) occurred between 5 November 2020 and 13 January 2021. This ruling concerns the question of whether the State Secretary correctly established the effective date as 13 January 2021. The court (de rechtbank) has considered that the State Secretary correctly established the effective date of the residence permit as 13 January 2021.
