The measure by which the administrative detention of an alien (vreemdelingenbewaring) is imposed on the basis of Article 59, 59a or 59b of the Act shall be dated and signed; the measure shall state the reasons on which it is based. A copy thereof shall be issued immediately to the alien to whom the measure relates. The alien shall be informed thereby in writing, in a language which he understands or which he may reasonably be assumed to understand, of the reasons for the administrative detention of an alien and of the legal remedies available against the imposition of the measure, as well as of the possibility to apply for free legal assistance and representation.
The first paragraph shall apply mutatis mutandis in the event of the imposition of a measure involving deprivation of liberty on the basis of Article 6, third or sixth paragraph, of the Act and in situations in which the immigration detention of the foreign national is continued on another legal basis.
De maatregel waarbij de vreemdelingenbewaring op grond van artikel 59, 59a of 59b van de Wet wordt opgelegd wordt gedagtekend en ondertekend; de maatregel wordt met redenen omkleed. Aan de vreemdeling op wie de maatregel betrekking heeft, wordt onmiddellijk een afschrift daarvan uitgereikt. De vreemdeling wordt daarbij schriftelijk, in een taal die hij verstaat of waarvan redelijkerwijs kan worden aangenomen dat hij deze verstaat, op de hoogte gebracht van de redenen van vreemdelingenbewaring en van de rechtsmiddelen die tegen oplegging van de maatregel openstaan, alsook van de mogelijkheid om gratis rechtsbijstand en vertegenwoordiging aan te vragen.
Het eerste lid is van overeenkomstige toepassing in geval van oplegging van de vrijheidsontnemende maatregel op grond van artikel 6, derde of zesde lid, van de Wet en in situaties waarin de vreemdelingenbewaring van de vreemdeling op een andere wettelijke grondslag wordt voortgezet.
