1. The date of filing of an application for a registered Community design shall be the date on which documents containing the information specified in Article 36(1) are filed with the Office by the applicant, or, if the application has been filed with the central industrial property office of a Member State or with the Benelux Design Office, with that office.
2. By derogation from paragraph 1, the date of filing of an application filed with the central industrial property office of a Member State or with the Benelux Design Office and reaching the Office more than two months after the date on which documents containing the information specified in Article 36(1) have been filed shall be the date of receipt of such documents by the Office.

De datum van indiening van de aanvrage om een ingeschreven Gemeenschapsmodel is die waarop de aanvrager de stukken met de in artikel 36, lid 1, bedoelde gegevens voorlegt aan het Bureau of aan de centrale dienst voor de industriële eigendom van een lidstaat dan wel aan het Benelux-bureau voor tekeningen of modellen, indien de aanvrage daar wordt ingediend.
2. In afwijking van lid 1 geldt als datum van indiening van een aanvrage die bij de centrale dienst voor de industriële eigendom van een lidstaat of bij het Benelux-bureau voor tekeningen of modellen is ingediend en die het Bureau meer dan twee maanden na de datum van indiening van de stukken met de in artikel 36, lid 1, genoemde informatie bereikt, de datum van ontvangst van die stukken door het Bureau.
