Any provision in the law of a Member State allowing use of national designs by or for the government may be applied to Community designs, but only to the extent that the use is necessary for essential defence or security needs.

Section 5

Invalidity

De bepalingen in de wetgeving van een lidstaat die het gebruik van nationale modellen door of voor de overheid toestaan kunnen op Gemeenschapsmodellen worden toegepast, doch uitsluitend voorzover het gebruik noodzakelijk is voor wezenlijke defensie- of veiligheidsbehoeften.
