This chapter contains the policy rules applicable to foreign nationals who wish to reside in the Netherlands for the following residence purposes:
seeking and performing work, whether or not in salaried employment;
employment as a highly skilled migrant (kennismigrant)
research within the meaning of Directive (EU) 2016/801;
work as a self-employed person;
holder of a European Blue Card within the meaning of Directive 2021/1883/EU; or
intra-corporate transfer within an enterprise.
The policy rules are a supplement to or an elaboration of the following articles from the Vb, the BuWav and the VV:
Articles 3.3, 3.4, 3.23b, 3.23c, 3.30, 3.30a, 3.30b, 3.30d, 3.32, 3.33 and 3.42, 3.89b, 3.89ba, 3.91c, 4.43 and 4.47 of the Aliens Decree (Vreemdelingenbesluit);
Articles 2.1, 2.2, 2.3 and 2.6 BuWav;
Articles 3.20a, 3.20b, 3.20c, 3.20d, 3.23, 4.24, 4.35 and 4.36 VV.
The policy rules regarding short-term mobility within the European Union of researchers and their family members are a supplement to or an elaboration of Articles 8 and 12 of the Vw.
In dit hoofdstuk zijn de beleidsregels opgenomen die gelden voor vreemdelingen die in Nederland willen verblijven voor de volgende verblijfsdoelen:
het zoeken naar en verrichten van arbeid al dan niet in loondienst;
arbeid als kennismigrant;
onderzoek in de zin van richtlijn (EU) 2016/801;
arbeid als zelfstandige;
houder van een Europese blauwe kaart in de zin van richtlijn 2021/1883/EU; of
overplaatsing binnen een onderneming.
De beleidsregels zijn een aanvulling op of een uitwerking van de volgende artikelen uit het Vb, het BuWav en het VV:
artikelen 3.3, 3.4, 3.23b, 3.23c, 3.30, 3.30a, 3.30b, 3.30d, 3.32, 3.33 en 3.42, 3.89b, 3.89ba, 3.91c, 4.43 en 4.47 Vb;
artikelen 2.1, 2.2, 2.3 en 2.6 BuWav;
artikelen 3.20a, 3.20b, 3.20c, 3.20d, 3.23, 4.24, 4.35 en 4.36 VV.
De beleidsregels over kortermijnmobiliteit binnen de Europese Unie van onderzoekers en hun gezinsleden zijn een aanvulling op of een uitwerking van de artikelen 8 en 12 uit de Vw.
