If the evidence demonstrating the lawful residence of a foreign national is missing, has been lost, or has become unfit for identification, the foreign national must report this to the Chief of Police (Korpschef). The Chief of Police shall send a copy of the official report (proces-verbaal) of the notification to the IND. The IND shall ensure that the number of the evidence concerned is recorded in the Verification and Information System of DLOS, and the IND shall signal the evidence in the (N)SIS for a period of ten years.
If it is established by the official charged with border control or with the supervision of foreign nationals that irregularities have been committed with a valid document for crossing borders issued by the Dutch government, the official charged with border control or with the supervision of foreign nationals must send a notification thereof to the Ministry of the Interior and Kingdom Relations.
The foreign national must, for the replacement or renewal of residence documents for reasons as referred to in Article 4.22, paragraph 1, of the Aliens Decree (Vreemdelingenbesluit), submit a completed application form to the IND.
The issuance of documents for the purpose of establishing his identity, nationality, and residence status as referred to in Article 4.21 of the Aliens Decree (Vreemdelingenbesluit) (both in the event of replacement and renewal), shall be performed by the IND.
Course of action regarding foreign nationals without means of proof
The official charged with border control or with the supervision of foreign nationals must, in any event, observe the following lines of conduct in respect of foreign nationals without means of evidence:
the official charged with border control or with the supervision of foreign nationals must not rely too readily on a statement by a foreign national that the foreign national is not (or is no longer) in possession of a valid document for border crossing;
upon the taking of fingerprints of a foreign national, the form containing the fingerprints must be provided with a signature of the foreign national;
the official charged with border control or with the supervision of foreign nationals may call upon the assistance of an interpreter if, due to language difficulties, no or insufficient contact with the foreign national is possible;
the official charged with border control or with the supervision of foreign nationals must make photocopies of all items of evidence found that may be supportive in establishing the identity and nationality of the foreign national.
The Police Chief or the Commander of the Royal Netherlands Marechaussee (Koninklijke Marechaussee) shall transmit the results of the identity and nationality investigation to the Repatriation and Departure Service (Dienst Terugkeer en Vertrek) as soon as these are known by sending a transfer file to the Repatriation and Departure Service. Prior to the departure of the foreign national, the Repatriation and Departure Service requires information from the transfer file for the purpose of obtaining a valid document for crossing the border for the foreign national.
Als het bewijsmiddel waaruit het rechtmatig verblijf blijkt van een vreemdeling wordt vermist, verloren is gegaan of ondeugdelijk is geworden voor identificatie, moet de vreemdeling hiervan aangifte doen bij de Korpschef. De Korpschef zendt een afschrift van het proces-verbaal van de aangifte aan de IND. De IND draagt zorg dat het nummer van het betreffende bewijsmiddel wordt opgenomen in het Verificatie- en Informatiesysteem van DLOS en de IND signaleert het bewijsmiddel in het (N)SIS voor de duur van tien jaar.
Als door de ambtenaar belast met de grensbewaking of met het toezicht op vreemdelingen wordt geconstateerd dat onregelmatigheden zijn gepleegd met een door de Nederlandse overheid afgegeven geldige document voor grensoverschrijding, moet de ambtenaar belast met de grensbewaking of met het toezicht op vreemdelingen hiervan een bericht zenden aan het Ministerie van Binnenlandse Zaken en Koninkrijksrelaties.
De vreemdeling moet voor het vervangen of het vernieuwen van verblijfsdocumenten, om redenen als genoemd in artikel 4.22, eerste lid, Vb, een ingevuld aanvraagformulier verzenden naar de IND.
De afgifte van documenten ter vaststelling van zijn identiteit, nationaliteit en verblijfsstatus als bedoeld in artikel 4.21 Vb (zowel ingeval van vervanging als van vernieuwing), gebeurt door de IND.
Gedragslijn bij vreemdelingen zonder bewijsmiddelen
De ambtenaar belast met de grensbewaking of met het toezicht op vreemdelingen moet in ieder geval de volgende gedragslijnen in acht nemen bij vreemdelingen zonder bewijsmiddelen:
de ambtenaar belast met de grensbewaking of met het toezicht op vreemdelingen moet niet te snel afgaan op de verklaring van een vreemdeling dat de vreemdeling niet (of niet meer) in het bezit is van een geldig document voor grensoverschrijding;
bij het afnemen van vingerafdrukken van een vreemdeling, moet het formulier met de vingerafdrukken voorzien worden van een handtekening van de vreemdeling;
de ambtenaar belast met de grensbewaking of met het toezicht op vreemdelingen mag de hulp van een tolk inroepen als door moeilijkheden met de taal geen of onvoldoende contact met de vreemdeling mogelijk is;
de ambtenaar belast met de grensbewaking of met het toezicht op vreemdelingen moet van alle aangetroffen bewijsmiddelen die ondersteunend kunnen zijn bij het vaststellen van de identiteit en nationaliteit van de vreemdeling, fotokopieën maken.
De Korpschef of de Commandant der KMar zendt de uitkomsten van het identiteits- en nationaliteitsonderzoek naar DTenV, zodra dit bekend is door een overdrachtsdossier naar DTenV te versturen. DTenV heeft voor het vertrek van de vreemdeling informatie uit het overdrachtsdossier nodig voor het verkrijgen van een geldig document voor grensoverschrijding voor de vreemdeling.
