Duty of care
A carrier must instruct its personnel in such a manner that inspection of travel documents takes place at check-in and upon departure to the Netherlands. The personnel of the carrier includes the personnel who perform certain formalities under its responsibility. The personnel of the carrier must, during the inspection of the travel documents, determine whether a document for crossing the border is valid.
The carrier must at least verify whether:
the name, date of birth, nationality, sex, height and photograph, as recorded in the presented document for border crossing, correspond to the provider of the document for border crossing;
the presented document for crossing the border is provided with the required visas (both for the Netherlands and for the country of final destination);
the period of validity of the presented document for crossing the border and the visas affixed therein has not expired;
the document presented for crossing the border has been issued by a thereto competent authority.
The carrier shall provide, via the web service (Article 13 EES Regulation), the necessary data to the EES system to verify whether third-country nationals who hold a short-stay visa for one or two entries have or have not exhausted the number of entries to which their visa entitles them. On that basis, the web service shall provide carriers with the answer OK/NOT OK.
The carrier must, by means of a brief and concise examination, verify whether the document presented for crossing the border is false or forged, whereby simple aids must be used if necessary.
At boarding points where the carrier uses technical equipment for the inspection of transport tickets, the carrier must use this equipment for the inspection of documents for border crossing.
The Dutch government is authorised to issue instructions to the carrier to take additional precautionary measures for the check prior to departure in the case of transport that is designated as risk-bearing. These instructions may, for example, consist of adjusting the method of checking (additional check before boarding) or the use of technical aids.
The Dutch government may request a carrier, on the basis of the relevant international regulations, to make a seat on board a sea vessel or aircraft available to an official expert in the field of travel documents on a high-risk flight or voyage. The official expert in the field of travel documents may, at the point of embarkation and on the occasion of boarding, advise carriers as to whether the travel documents presented are genuine and unfalsified, and whether the travel document presented is provided with the required visas both for the Netherlands and for the country of final destination. The official expert in the field of travel documents may exercise this power if permission to that effect has been granted by the state in which the point of embarkation is situated.
The Dutch government shall, in order to enable carriers to perform the check of travel documents as effectively as possible, regularly inform carriers of changes in the documents and visas required for entry into the Netherlands. The Dutch government shall provide instructions to the carrier that can achieve a more effective and efficient check.
The official in charge of border control shall draw up a report (proces-verbaal) if the carrier brings in an undocumented or incorrectly documented foreign national without prior permission from the competent authorities.
Duty to provide a copy
The carrier who, pursuant to Article 2.2 of the Aliens Decree (Vreemdelingenbesluit), is obliged to make a copy of a valid document for crossing borders must, upon request, provide the images within one hour after the petition to the official charged with border control, if an alien, upon entry into the Netherlands, appears not to possess (the correct) travel documents.
The official charged with border control is not required to possess the exact details of the flight on which the foreign national arrived. An indication, obtained from the statements of the foreign national or from other sources, is sufficient for this purpose.
Duty to provide passenger information
Directive 2004/82/EC, or the API Directive, aims to improve border controls and combat illegal immigration by providing that air carriers, upon request, provide passenger data (the so-called Advance Passenger Information, API data) in advance to the officials charged with border control. This concerns, among other things, data from the travel document and regarding the journey of the passenger concerned. The official charged with border control determines, on the basis of Article 2.2a of the Aliens Decree (Vreemdelingenbesluit), in respect of which places of departure and from which carriers the passenger data shall be requested. The official charged with border control shall, on the basis of Article 2.2b of the Aliens Decree, destroy the obtained passenger data within 24 hours after the entry of the passengers into the Netherlands, unless these are later required for the performance of his duties. If the passenger belongs to a category of foreign nationals in respect of whom there is an increased risk of illegal immigration, the official charged with border control shall destroy the data 4 days after the entry of the passengers into the Netherlands, unless these are later required for the performance of his duties. Risk indicators are used for the identification of foreign nationals who pose a risk of illegal immigration. The risk indicators are based on, inter alia, data from regular and asylum-related refusals in the past, on information from liaisons, on deviating flight movements, and on the basis of claims imposed in the past within the framework of Article 4 of the Aliens Act (Vreemdelingenwet).
The carrier who, upon the request of the official charged with border control on the basis of Article 2.2a of the Aliens Decree (Vreemdelingenbesluit), transmits passenger data, shall use for this purpose the International Air Transport Association (IATA) message format, type B, with the structure based on the classification for electronic data interchange for administration, commerce and transport established by the United Nations Economic Commission for Europe, published under the title: Electronic Data Interchange For Administration, Commerce and Transport (EDIFACT) Passenger List Message (PAXLST). The IATA address to which the data must be transmitted is HDQKMXH.
Duty to return (terugvoerplicht)
The carrier is obliged to return a foreign national whom it has transported to the Netherlands and who has been refused entry to the Schengen area, upon the instruction of the official charged with border surveillance, to a place outside the Schengen area. A refusal of entry shall be deemed to have occurred notwithstanding the fact that the refusal of entry was initially postponed or suspended because the foreign national submitted an application for an asylum residence permit. The carrier shall transport the foreign national to at least one of the following countries:
the third country from which the foreign national was brought;
the third country that issued the valid document for border crossing with which the foreign national has travelled;
a third country where the admission of the foreign national is guaranteed.
This obligation of the carrier to return shall apply in all of the following situations:
in cases of refusal of entry to foreign nationals who do not possess (the correct) documents for crossing the border;
in the event of refusals of entry on the basis of one of the other grounds of Article 3 of the Aliens Act (Vreemdelingenwet) and/or Article 6 of the Schengen Borders Code (SGC);
upon the stopping of foreign nationals with a view to expulsion within six months after entry. For the determination of the six-month period, the time of the stopping shall be decisive.
The official in charge of border control shall claim foreign nationals who are refused entry for take-back by the carrier.
For the transport of the foreign national by the carrier to a place outside the Netherlands, ‘removal orders’ are utilised (see model M30 and the similar model for aviation as referred to in Chapter 5 of Annex 9 to the Chicago Convention). The official charged with border supervision shall, in order to facilitate the return of a foreign national to a place outside the Netherlands by the carrier, make use of the certificates utilised in an international context for that purpose, intended for the authorities charged with immigration/border supervision in the country of destination (see Appendix 9, under 1 and 2, of Annex 9 to the Chicago Convention).
The foreign national who has been refused entry must, until the time of the execution of the return, remain in the area designated for that purpose by the official charged with border surveillance, which area may be locked or otherwise secured against unauthorised departure therefrom.
The carrier is responsible for the foreign national during the entire period from the moment the instruction was given to the carrier to return the foreign national to a place outside the Netherlands, until the moment the foreign national has actually been transported by the carrier to a place outside the Netherlands.
If the carrier is unable to return the foreign national within a reasonable period, the Minister may recover the costs associated with the removal, including the costs of stay, from the carrier (see paragraph A1/9 Vc Liability for removal and stay costs).
The official in charge of border control shall re-examine whether the foreign national meets the requirements for entry if:
the expulsion of a foreign national who, at the time of the expulsion, had been refused entry, fails; and
the foreign national returns after the foreign national had left the Dutch territory on board an aircraft or sea-going vessel.
The official in charge of border control shall refuse the foreign national re-entry into the Netherlands if the foreign national does not meet the conditions.
The official charged with border supervision shall issue a new instruction to the carrier to return the foreign national, without compensation of costs, to a place outside the Netherlands (see model M30 and the similar model for aviation as referred to in Chapter 5 of Annex 9 to the Chicago Convention) if the foreign national has previously been removed on the basis of Article 65 of the Aliens Act (Vreemdelingenwet).
The foreign national who leaves the Netherlands of their own motion, but who is refused entry by the authorities of the country of destination or transit and is sent back, must satisfy the conditions for entry upon return to the Netherlands. The officer charged with border supervision shall refuse entry to the Netherlands if the foreign national does not satisfy the conditions for entry. The officer charged with border supervision may not impose upon the carrier, through whose intervention the foreign national was transported back to the Netherlands, the obligation under Article 65 of the Aliens Act (Vreemdelingenwet) to transport the foreign national to a place outside the Netherlands.
The official charged with border control shall effectuate the departure of foreign nationals who do not submit an application for an asylum residence permit at at least one of the following moments:
as soon as the supplying seagoing vessel departs, or at an earlier time if the departure, in consultation with the responsible shipowner, can be effected in another manner;
as soon as placement on board an aircraft of the airline concerned is possible with the place of embarkation as the destination, or another place where the entry of the foreign national is guaranteed, see Annex 9 to the Chicago Convention.
Stowaways
The carrier may use the passenger lists referred to in Annex 14c and 14d of the VV for the notification of stowaways found.
If a foreign national who has been found as a stowaway on board a seagoing vessel is not sufficiently documented, the diplomatic or consular representation of the country from which the foreign national presumably originates must establish the identity and/or nationality of the foreign national and issue a replacement travel document to the foreign national. The diplomatic or consular representation of the country from which the foreign national presumably originates must establish the nationality and identity and issue the replacement travel documents before the moment at which the seagoing vessel with which the stowaway was brought has left the port. The execution of the return obligation in this manner may not result in the loss of a unique removal opportunity.
The master of a seagoing vessel may not simply evade the return of the foreign national on board by invoking Regulation 8 of the International Convention for the Safety of Life at Sea. The official charged with border control must, if the master invokes this regulation, assess the circumstances cited by the master and weigh them against the interest of returning the foreign national on board.
Foreigners with a refugee story
If the foreign national, at the moment of departure, states that his life is in immediate danger in the country from which he wishes to depart, the carrier may not send the foreign national to the Netherlands diplomatic or consular representation to submit an application for an mvv for the purpose of ‘asylum’. The carrier must contact the IND if the carrier is considering transporting a foreign national who states that his life is in immediate danger.
The Head of the IND shall then determine whether the foreign national concerned may be brought to the Netherlands, even if he is not in possession of the correct travel documents. If a carrier has transported a foreign national who is not documented or not correctly documented to Dutch territory with the consent of the Head of the IND, no obligation to return shall apply. The official charged with border control shall not draw up an official report (proces-verbaal) of a suspected violation by the carrier of Article 4 of the Aliens Act (Vw).
Criminal liability
The officer in charge of border control shall draw up an official report (proces-verbaal) in all cases where, as a result of the carrier's failure to comply with the duty of care or the duty to provide a copy, an undocumented or incorrectly documented foreign national has been brought into the Netherlands (see Article 4, paragraphs 1, 2 and 3, Aliens Act (Vw), Article 5, paragraphs 1 and 2, Aliens Act (Vw), Article 65, paragraph 3, Aliens Act (Vw) and Article 197a Criminal Code (WvSr)). The officer in charge of border control shall forward all official reports to the Public Prosecution Service (OM). The Public Prosecution Service shall first offer a settlement (transactie) to the violator of the duty of care or the duty to provide a copy.
Liability for expulsion and residence costs
The DTenV shall recover the costs associated with the removal from the carrier after the foreign national has become lawfully removable, and the official charged with border supervision has given the carrier the instruction to transport the foreign national back to a place outside the Netherlands.
After a foreign national has been returned by a carrier, all government authorities shall provide the DT&V with an overview of the costs they have incurred in respect of the foreign national concerned. The government authorities shall do so on the basis of the tariff list as included in Annex 22 of the VV. These standardised tariffs concern the costs of deportation and the costs of stay incurred by the government in respect of foreign nationals who have been refused entry to the Netherlands. The tariffs are based on the costs actually incurred by the various government authorities. The DT&V shall send the carrier an invoice comprising the costs incurred by the various government authorities.

Zorgplicht
Een vervoerder moet zijn personeel zodanig instrueren, dat controle van reisdocumenten plaatsvindt bij het inchecken en bij vertrek naar Nederland. Onder het personeel van de vervoerder valt het personeel dat onder zijn verantwoordelijkheid bepaalde formaliteiten verricht. Het personeel van de vervoerder moet bij de controle van de reisdocumenten vaststellen of een document voor grensoverschrijding geldig is.
De vervoerder moet ten minste controleren of:
de naam, geboortedatum, nationaliteit, geslacht, lengte en foto, zoals die in het aangeboden document voor grensoverschrijding zijn opgenomen, overeenkomen met de aanbieder van het document voor grensoverschrijding;
het aangeboden document voor grensoverschrijding voorzien is van de benodigde visa (zowel voor Nederland als voor het land van uiteindelijke bestemming);
de geldigheidsduur van het aangeboden document voor grensoverschrijding en de daarin aangebrachte visa niet is verlopen;
het aangeboden document voor grensoverschrijding is afgegeven door een daartoe bevoegde autoriteit.
De vervoerder verstrekt via de webdienst (artikel 13 EES-verordening) de noodzakelijk gegevens aan het EES systeem om na te gaan of onderdanen van derde landen die houder zijn van een visum voor kort verblijf voor één of twee binnenkomsten al dan niet het aantal binnenkomsten waarop hun visum recht geeft, hebben opgebruikt. Op die basis verstrekt de webdienst vervoerders het antwoord OK/NIET OK.
De vervoerder moet door middel van een kort en bondig onderzoek controleren of het aangeboden document voor grensoverschrijding vals of vervalst is, waarbij zonodig gebruik gemaakt moet worden van eenvoudige hulpmiddelen.
Op opstapplaatsen waar door de vervoerder bij de controle van vervoersbewijzen gebruik gemaakt wordt van technische apparatuur, moet de vervoerder deze apparatuur voor de controle van documenten voor grensoverschrijding gebruiken.
De Nederlandse overheid is bevoegd de vervoerder aanwijzingen te geven om extra voorzorgsmaatregelen te nemen voor de controle voorafgaand aan het vertrek bij vervoer dat als risicodragend wordt aangemerkt. Deze aanwijzingen kunnen bijvoorbeeld bestaan uit het aanpassen van de wijze van controle (extra controle voor het instappen) of het gebruik van technische hulpmiddelen.
De Nederlandse overheid mag een vervoerder verzoeken, op grond van de daartoe strekkende internationale regelgeving, om op een risicodragende vlucht of vaart een plaats aan boord van het zeeschip of vliegtuig ter beschikking te stellen aan een ambtenaar deskundig op het terrein van reisdocumenten. De ambtenaar deskundig op het terrein van reisdocumenten mag in de opstapplaats, ter gelegenheid van het aan boord gaan, vervoerders adviseren of de aangeboden reisdocumenten echt en onvervalst zijn, en het aangeboden reisdocument voorzien is van de benodigde visa zowel voor Nederland als voor het land van uiteindelijke bestemming. De ambtenaar deskundig op het terrein van reisdocumenten mag deze bevoegdheid uitoefenen als daartoe door de staat waarin de opstapplaats is gelegen toestemming is verleend.
De Nederlandse overheid houdt, om vervoerders in staat te stellen de controle op reisdocumenten zo goed mogelijk te verrichten, vervoerders regelmatig op de hoogte van wijzigingen in de voor toegang tot Nederland vereiste documenten en visa. De Nederlandse overheid geeft aanwijzingen aan de vervoerder die een effectievere en efficiëntere controle kunnen bewerkstelligen.
De ambtenaar belast met de grensbewaking maakt een proces-verbaal op als de vervoerder een niet of onjuist gedocumenteerde vreemdeling aanvoert zonder voorafgaande toestemming van de bevoegde autoriteiten.
Afschriftplicht
De vervoerder die op grond van artikel 2.2 Vb verplicht is een afschrift te maken van een geldig document voor grensoverschrijding moet de afbeeldingen desgevraagd binnen één uur na het verzoek geven aan de ambtenaar belast met de grensbewaking, als een vreemdeling bij binnenkomst in Nederland niet over (de juiste) reisdocumenten blijkt te beschikken.
De ambtenaar belast met de grensbewaking hoeft niet over de exacte gegevens beschikken van de vlucht waarmee de vreemdeling is aangekomen. Een indicatie, verkregen uit de verklaringen van de vreemdeling of uit andere bronnen is hiertoe voldoende.
Passagiersinformatieplicht
Richtlijn 2004/82/EG, ofwel de API-richtlijn heeft tot doel de grenscontroles te verbeteren en illegale immigratie te bestrijden door erin te voorzien dat luchtvervoerders desgevraagd passagiersgegevens (de zogenoemde Advance Passenger Information, API-gegevens) vooraf verstrekken aan de ambtenaren belast met de grensbewaking. Het gaat hier onder andere om gegevens uit het reisdocument en over de reis van de desbetreffende passagier. De ambtenaar belast met de grensbewaking bepaalt op grond van artikel 2.2a Vb ten aanzien van welke plaatsen van vertrek en van welke vervoerders de passagiersgegevens zullen worden gevorderd. De ambtenaar belast met de grensbewaking vernietigt op grond van artikel 2.2b Vb de verkregen passagiersgegevens binnen 24 uur na binnenkomst van de passagiers in Nederland, tenzij deze later nodig zijn voor de uitoefening van diens taken. Indien de passagier behoort tot een categorie vreemdelingen, ten aanzien waarvan een verhoogd risico bestaat op illegale immigratie vernietigt de ambtenaar belast met de grensbewaking de gegevens 4 dagen na binnenkomst van de passagiers in Nederland, tenzij deze later nodig zijn voor de uitoefening van diens taken. Voor het onderkennen van vreemdelingen die een risico vormen voor illegale immigratie worden risico indicatoren gebruikt. De risico indicatoren zijn gebaseerd op onder andere gegevens van reguliere en asiel gerelateerde weigeringen uit het verleden, op informatie van liaisons, op afwijkende vliegbewegingen en op basis van claims die in het verleden zijn opgelegd in het kader van artikel 4 Vw.
De vervoerder die op vordering van de ambtenaar belast met de grensbewaking op grond van artikel 2.2a Vb passagiersgegevens verzendt, gebruikt hiervoor het International Air Transport Association (IATA)-berichtenformat, type B, met de structuur die is gebaseerd op de vanwege de Economische Commissie voor Europa van de Verenigde Naties vastgestelde indeling voor elektronische gegevensuitwisseling voor overheid, handel en vervoer, gepubliceerd onder de titel: Electronic Data Interchange For Administration, Commerce and Transport (EDIFACT) Passenger List Message (PAXLST). Het IATA-adres waar de gegevens naartoe verzonden moeten worden, is HDQKMXH.
Terugvoerplicht
De vervoerder is verplicht om een vreemdeling die hij naar Nederland heeft vervoerd en aan wie de toegang tot het Schengengebied is geweigerd, op aanwijzing van de ambtenaar belast met de grensbewaking terug te brengen naar een plaats buiten het Schengengebied. Van toegangsweigering is onverminderd sprake indien de toegangsweigering in eerste instantie is uitgesteld of opgeschort omdat de vreemdeling een aanvraag voor een verblijfsvergunning asiel heeft ingediend. De vervoerder brengt de vreemdeling naar in ieder geval één van de volgende landen:
het derde land van waaruit de vreemdeling werd aangevoerd;
het derde land dat het geldige document voor grensoverschrijding heeft afgegeven waarmee de vreemdeling heeft gereisd;
een derde land waar de toelating van de vreemdeling is gewaarborgd.
Deze terugvoerplicht van de vervoerder geldt in alle volgende situaties:
bij weigeringen van toegang van vreemdelingen die niet beschikken over (de juiste) documenten voor grensoverschrijding;
bij weigeringen van toegang op basis van één van de andere gronden van artikel 3 Vw en/of artikel 6 SGC;
bij staande houding van vreemdelingen met het oog op uitzetting binnen zes maanden na binnenkomst. Voor de vaststelling van de termijn van zes maanden is beslissend het tijdstip van de staande houding.
De ambtenaar belast met de grensbewaking claimt vreemdelingen aan wie de toegang wordt geweigerd voor terugname bij de vervoerder.
Voor het vervoer van de vreemdeling door de vervoerder naar een plaats buiten Nederland worden ‘removal orders’ gehanteerd (zie model M30 en het voor de luchtvaart soortgelijke model als bedoeld in Hoofdstuk 5 van Annex 9 bij het Verdrag van Chicago). De ambtenaar belast met de grensbewaking maakt, om het terugvoeren van een vreemdeling naar een plaats buiten Nederland door de vervoerder te faciliteren, gebruik van de daarvoor in internationaal verband gehanteerde attesten, bedoeld voor de met immigratie/grensbewaking belaste autoriteiten in het land van bestemming (zie Appendix 9, onder 1 en 2, van de Annex 9 bij het Verdrag van Chicago).
De vreemdeling aan wie de toegang is geweigerd moet zich tot op het tijdstip van uitvoering van de terugbrenging ophouden in de hem daartoe door de ambtenaar belast met de grensbewaking aangewezen ruimte, die kan worden afgesloten of op andere wijze kan worden verzekerd tegen ongeoorloofd vertrek daaruit.
De vervoerder is verantwoordelijk voor de vreemdeling gedurende de gehele periode vanaf het moment dat aan de vervoerder de aanwijzing is gegeven de vreemdeling terug te brengen naar een plaats buiten Nederland, tot aan het moment dat de vreemdeling daadwerkelijk door de vervoerder naar een plaats buiten Nederland is vervoerd.
Als de vervoerder de vreemdeling niet binnen redelijke termijn terug kan brengen, mag de minister de met de verwijdering gepaard gaande kosten, waaronder de verblijfskosten, op de vervoerder verhalen (zie paragraaf A1/9 Vc Aansprakelijkheid voor uitzettings- en verblijfskosten).
De ambtenaar belast met de grensbewaking bekijkt opnieuw of de vreemdeling voldoet aan de voorwaarden voor toegang als:
de uitzetting van een vreemdeling aan wie ten tijde van de uitzetting de toegang was geweigerd, mislukt; en
de vreemdeling terugkeert nadat de vreemdeling aan boord van een vliegtuig of zeeschip het Nederlands grondgebied had verlaten.
De ambtenaar belast met de grensbewaking weigert de vreemdeling opnieuw de toegang tot Nederland als de vreemdeling niet aan de voorwaarden voldoet.
De ambtenaar belast met de grensbewaking geeft de vervoerder een nieuwe aanwijzing om de vreemdeling zonder kostenvergoeding terug te voeren naar een plaats buiten Nederland (zie model M30 en het voor de luchtvaart soortgelijke model als bedoeld in Hoofdstuk 5 van Annex 9 bij het Verdrag van Chicago) als de vreemdeling eerder op grond van artikel 65 Vw is verwijderd.
De vreemdeling die Nederland uit eigen beweging verlaat, maar aan wie door de autoriteiten van het land van bestemming of van transit de toegang wordt geweigerd en wordt teruggezonden moet bij terugkomst in Nederland voldoen aan de voorwaarden voor toegang. De ambtenaar belast met de grensbewaking weigert de toegang tot Nederland als de vreemdeling niet aan de voorwaarden voor toegang voldoet. De ambtenaar belast met de grensbewaking mag de vervoerder door wiens tussenkomst de vreemdeling terug naar Nederland is vervoerd niet de verplichting van artikel 65 Vw opleggen tot het vervoeren van de vreemdeling naar een plaats buiten Nederland.
De ambtenaar belast met de grensbewaking effectueert het vertrek van vreemdelingen die geen aanvraag om een verblijfsvergunning asiel indienen op ten minste één van de volgende momenten:
zodra het aanvoerende zeeschip vertrekt, of op een eerder tijdstip als het vertrek, in overleg met de verantwoordelijke reder, op andere wijze kan worden geëffectueerd;
zodra plaatsing aan boord van een vliegtuig van de betreffende maatschappij mogelijk is met als bestemming de plaats van het opstappen dan wel een andere plaats waar de toegang van de vreemdeling gewaarborgd is, zie Annex 9 van het Verdrag van Chicago.
Verstekelingen
De vervoerder mag de in bijlage 14c en 14d VV genoemde passagierslijsten gebruiken voor de opgave van aangetroffen verstekelingen.
Als een vreemdeling die als verstekeling is aangetroffen aan boord van een zeeschip niet voldoende gedocumenteerd is, moet de diplomatieke of consulaire vertegenwoordiging van het land waar de vreemdeling vermoedelijk vandaan komt de identiteit en/of nationaliteit van de vreemdeling vaststellen en aan de vreemdeling een vervangend reisdocument geven. De diplomatieke of consulaire vertegenwoordiging van het land van waar de vreemdeling vermoedelijk vandaan komt moet de nationaliteit en identiteit vaststellen en de vervangende reisdocumenten afgeven voor het moment waarop het zeeschip waarmee de verstekeling is aangevoerd de haven heeft verlaten. De uitvoering van de terugvoerverplichting op deze wijze mag niet tot gevolg hebben dat een unieke verwijdermogelijkheid verloren gaat.
De gezagvoerder van een zeeschip mag zich niet zonder meer onttrekken aan terugplaatsing van de vreemdeling aan boord, door een beroep te doen op voorschrift 8 Internationaal Verdrag voor de beveiliging van mensenlevens op zee. De ambtenaar belast met de grensbewaking moet, als de gezagvoerder zich op dit voorschrift beroept, de omstandigheden die de gezagsvoerder aanvoert beoordelen en afwegen tegen het belang van terugplaatsing van de vreemdeling aan boord.
Vreemdelingen met een vluchtrelaas
Als de vreemdeling op het moment van vertrek stelt dat zijn leven in het land van waar hij wil vertrekken in direct gevaar is, mag de vervoerder de vreemdeling niet naar de Nederlandse diplomatieke of consulaire vertegenwoordiging zenden om daar een aanvraag voor een mvv met als doel ‘asiel’ in te dienen. De vervoerder moet contact opnemen met de IND als de vervoerder overweegt een vreemdeling te vervoeren die stelt dat zijn leven in direct gevaar is.
Het Hoofd van de IND bepaalt dan of de betrokken vreemdeling, ook al is hij niet in het bezit van de juiste reisdocumenten, naar Nederland mag worden gebracht. Als een vervoerder een niet of niet juist gedocumenteerde vreemdeling naar Nederlands grondgebied heeft vervoerd met instemming van het hoofd van de IND, geldt geen terugvoerplicht. De ambtenaar belast met de grensbewaking maakt geen proces-verbaal op van vermoedelijke overtreding van de vervoerder van artikel 4 Vw.
Strafrechtelijke aansprakelijkheid
De ambtenaar belast met de grensbewaking maakt proces-verbaal op in alle gevallen waarin als gevolg van het nalaten van de zorg- of afschriftplicht door de vervoerder een niet of onjuist gedocumenteerde vreemdeling binnen Nederland is gebracht (zie artikel 4, eerste, tweede en derde lid, Vw, artikel 5, eerste en tweede lid, Vw, artikel 65, derde lid, Vw en artikel 197a WvSr). De ambtenaar belast met de grensbewaking zendt alle processen-verbaal door aan het OM. Het OM biedt eerst een transactie aan de overtreder van de zorg- of afschriftplicht aan.
Aansprakelijkheid voor uitzettings- en verblijfskosten
De DTenV verhaalt de met de verwijdering gepaard gaande kosten op de vervoerder nadat de vreemdeling rechtmatig verwijderbaar is geworden, en de ambtenaar belast met de grensbewaking de vervoerder de aanwijzing heeft gegeven de vreemdeling terug te vervoeren naar een plaats buiten Nederland.
Nadat een vreemdeling is terugvervoerd door een vervoerder, leveren alle overheidsinstanties de DTenV een overzicht aan van de kosten die zij met betrekking tot de betreffende vreemdeling hebben gemaakt. De overheidsinstanties doen dit aan de hand van de tarievenlijst zoals opgenomen in bijlage 22 van het VV. Deze gestandaardiseerde tarieven betreffen de kosten van uitzetting en de kosten van verblijf die de overheid maakt met betrekking tot vreemdelingen aan wie de toegang tot Nederland is geweigerd. De tarieven zijn gebaseerd op de werkelijk gemaakte kosten van de diverse overheidsinstanties. De DTenV stuurt de vervoerder een rekening die de kosten omvat die door de diverse overheidsinstanties zijn gemaakt.
