In the cases referred to in Article 73(1) of the Regulation, a European Cooperative Society with its statutory seat in the Netherlands shall be dissolved by the court upon the petition of an interested party or upon the petition of the Public Prosecution Service. Before pronouncing the dissolution, the court may grant the company the opportunity to remedy the established defects within a period to be determined by the court.
In de in artikel 73, eerste lid, van de Verordening bedoelde gevallen wordt een Europese coöperatieve vennootschap met statutaire zetel in Nederland door de rechtbank op verzoek van een belanghebbende dan wel op verzoek van het Openbaar Ministerie ontbonden. Alvorens de ontbinding uit te spreken kan de rechtbank de vennootschap in de gelegenheid stellen de geconstateerde gebreken binnen een door haar te bepalen termijn op te heffen.
