The Dutch Data Protection Authority (Autoriteit Persoonsgegevens) may, in the event of an infringement of the provisions of Article 10 of the Regulation or Article 31 of this Act, impose an administrative fine of up to 20,000,000 euros or, in the case of an undertaking, up to 4% of the total worldwide annual turnover of the preceding financial year, if that amount is higher.
Article 83, paragraphs 1 up to and including 3, of the Regulation shall apply mutatis mutandis.
The administrative fine shall accrue to the State.
De Autoriteit persoonsgegevens kan in geval van overtreding van het bepaalde in artikel 10 van de verordening of in artikel 31 van deze wet een bestuurlijke boete opleggen van ten hoogste 20.000.000 euro of, voor een onderneming, ten hoogste 4% van de totale wereldwijde jaaromzet in het voorgaande boekjaar indien dit bedrag hoger is.
Artikel 83, eerste tot en met derde lid, van de verordening zijn van overeenkomstige toepassing.
De bestuurlijke boete komt toe aan de Staat.
