In the event of a declaration of lack of jurisdiction by the arbitral tribunal as referred to in Article 1052, fifth paragraph, second sentence, arbitral appeal is permitted.
In the event of a declaration of jurisdiction or a declaration of lack of jurisdiction by the arbitral tribunal, the provisions of Article 1052, paragraphs 4 and 5, shall apply after a decision has been rendered on appeal, or the period applicable for such appeal has expired without being used, or earlier, if each of the parties has waived the right to appeal in writing, or later, at the time of premature termination of the appeal.
Ingeval van onbevoegdverklaring door het scheidsgerecht als bedoeld in artikel 1052, vijfde lid, tweede zin, is arbitraal hoger beroep toegelaten.
Ingeval van bevoegdverklaring en onbevoegdverklaring door het scheidsgerecht zijn de bepalingen van artikel 1052, vierde en vijfde lid, van toepassing nadat in hoger beroep uitspraak is gedaan, of de voor dit beroep geldende termijn ongebruikt is verstreken dan wel eerder, indien door ieder der partijen schriftelijk van hoger beroep afstand is gedaan, of later, op het moment van voortijdige beëindiging van het hoger beroep.
