Article 350

The appeal suspends the execution of the judgment, unless it has been stipulated therein that the same shall be executed provisionally in cases where this is permitted.
An appeal lodged against an interlocutory judgment against which, pursuant to Article 337, paragraph 2, no appeal lies before the final judgment has been rendered, or lodged by making use of the new time limit pursuant to Article 340, shall not stay the enforcement.
Het hooger beroep schorst de ten uitvoerlegging van het vonnis, indien daarbij niet is bepaald, dat hetzelve bij voorraad zal worden ten uitvoer gelegd in de gevallen waarin dit is toegelaten.
Het hoger beroep, ingesteld tegen een tussenvonnis waartegen ingevolge artikel 337, tweede lid, geen hoger beroep openstaat voordat het eindvonnis is gewezen of ingesteld met gebruikmaking van de nieuwe termijn ingevolge artikel 340, schorst de tenuitvoerlegging niet.
