In appeal, a statement of claim and a statement of defence shall be filed.
Nevertheless, in the event of an incidental appeal or if an exception is raised by the defendant against the principal appeal, the appellant shall, at his request, be granted a period of time to respond to the incidental appeal or the proposed exception by way of a statement of defense (conclusie).
In hoger beroep worden een conclusie van eis en een conclusie van antwoord genomen.
Niettemin zal ingeval van incidenteel beroep of indien door den verweerder eene exceptie tegen het principaal beroep wordt aangevoerd, den appellant, op zijn verlangen, een termijn verleend worden om het incidenteel beroep of de voorgestelde exceptie bij conclusie te beantwoorden.
