Article 340

If a timely appeal in cassation has been lodged against a judgment, but this judgment is found not to be subject to cassation, the period for lodging an appeal against that judgment shall commence to run anew from the day of the ruling in cassation, provided that the appeal in cassation was lodged within the period for appeal.
Indien tijdig beroep in cassatie van een vonnis is ingesteld, doch dit vonnis voor cassatie niet vatbaar wordt bevonden, vangt de termijn van beroep van dat vonnis opnieuw aan te rekenen van de dag der uitspraak in cassatie, mits het beroep in cassatie werd ingesteld binnen de termijn van beroep.
