1.

If a witness refuses to give their testimony, the court may, at the petition of the interested party, order that they be placed in civil contempt detention (gijzeling) at the expense of that party until they have fulfilled their obligation, provided that the detention may last for a maximum of one year. This provision does not apply if it concerns a party being heard as a witness.

2.

The court shall order the civil imprisonment (gijzeling) only if, in its judgment, the interest of establishing the truth justifies the application of that measure.

3.

The judge who ordered the civil imprisonment (gijzeling) shall terminate the civil imprisonment ex officio or upon petition of the person imprisoned if, in his judgment, the continuation thereof is no longer justified by the interest served by the application of the coercive measure.

1.
