The party who invokes the legal consequences of facts or rights alleged by it shall bear the burden of proof of those facts or rights, unless a different distribution of the burden of proof follows from any special rule or from the requirements of reasonableness and fairness.
De partij die zich beroept op rechtsgevolgen van door haar gestelde feiten of rechten, draagt de bewijslast van die feiten of rechten, tenzij uit enige bijzondere regel of uit de eisen van redelijkheid en billijkheid een andere verdeling van de bewijslast voortvloeit.
