Article 409a

The Supreme Court shall stay the proceedings as long as the claimant has not paid the court fees and the period referred to in Article 3a, paragraph 2, of the Civil Cases Court Fees Act is still running.
If the claimant has not paid the court fee in a timely manner, the Supreme Court shall declare the claimant inadmissible in its appeal in cassation, with an order for the claimant to pay the costs. Before the Supreme Court proceeds to do so, the Supreme Court shall provide the claimant with the opportunity to express its views regarding the failure to pay the court fee due in a timely manner.
Article 127a, paragraphs 3 and 4, shall apply mutatis mutandis.
De Hoge Raad houdt de zaak aan zolang de eiser het griffierecht niet heeft voldaan en de termijn genoemd in artikel 3a, tweede lid, van de Wet griffierechten burgerlijke zaken nog loopt.
Indien de eiser het griffierecht niet tijdig heeft voldaan, verklaart de Hoge Raad eiser niet ontvankelijk in zijn beroep in cassatie, met veroordeling van de eiser in de kosten. Voordat de Hoge Raad hiertoe overgaat, stelt de Hoge Raad eiser in de gelegenheid zich uit te laten over het niet tijdig voldoen van het verschuldigde griffierecht.
Artikel 127a, derde en vierde lid, is van overeenkomstige toepassing.
