In the event of the death of the party ruled against during the course of the period for appeal in cassation, a new period shall commence for the heirs or successors in title on the day following that of the death.
In any event, an appeal in cassation may still be lodged within four weeks after the expiry of the period referred to in Article 185 of Book 4 of the Civil Code (Burgerlijk Wetboek).
Bij overlijden van de in het ongelijk gestelde partij gedurende de loop van de cassatietermijn vangt voor de erfgenamen of rechtverkrijgenden een nieuwe termijn aan op de dag na die van het overlijden.
In ieder geval kan het beroep in cassatie nog worden ingesteld binnen vier weken na afloop van de termijn, bedoeld in artikel 185 van Boek 4 van het Burgerlijk Wetboek.
