With regard to patent applications for which the result of the prior art search has been communicated to the applicant, but for which the examination division of the Patent Office has not yet taken a decision as referred to in Article 24 of the Kingdom Patent Act on the date of entry into force of this article, the Patent Office shall, by way of derogation from Chapter II, Section II, of that Kingdom Act, grant a patent by placing a dated entry on the application in the form as submitted by the applicant or as subsequently amended by him.
If, on the date of entry into force of this article, the result of the investigation into the state of the art has not yet been communicated to the applicant, the patent shall be granted with effect from two months after the date on which the result of the investigation into the state of the art has been communicated to the applicant, which period may be extended once by two months by the Patent Office at the request of the applicant.
Op octrooiaanvragen ten aanzien waarvan het resultaat van het onderzoek naar de stand van de techniek aan de aanvrager is meegedeeld, maar de aanvraagafdeling van de Octrooiraad op de datum van inwerkingtreding van dit artikel nog geen besluit heeft genomen als bedoeld in artikel 24 van de Rijksoctrooiwet, verleent de Octrooiraad in afwijking van Hoofdstuk II, Afdeling II, van de die Rijkswet octrooi door het plaatsen van een gedateerde aantekening op de aanvrage in de vorm zoals deze door de aanvrager is ingediend of door hem nadien is gewijzigd.
Indien op de datum van inwerkingtreding van dit artikel het resultaat van het onderzoek naar de stand van de techniek nog niet aan de aanvrager is meegedeeld, wordt het octrooi verleend met ingang van twee maanden na de datum waarop het resultaat van het onderzoek van de stand van de techniek is meegedeeld aan de aanvrager, welke termijn op verzoek van de aanvrager door de Octrooiraad eenmaal met twee maanden kan worden verlengd.
