in forceMEASURES TO ADAPT EXCEPTIONS AND LIMITATIONS TO THE DIGITAL AND CROSS-BORDER ENVIRONMENT
1. Member States shall provide for an exception or limitation to the rights provided for in Article 5(a), (b), (d) and (e) and Article 7(1) of Directive 96/9/EC, Articles 2 and 3 of Directive 2001/29/EC, Article 4(1) of Directive 2009/24/EC and Article 15(1) of this Directive in order to allow the digital use of works and other subject matter for the sole purpose of illustration for teaching, to the extent justified by the non-commercial purpose to be achieved, on condition that such use:
(a) takes place under the responsibility of an educational establishment, on its premises or at other venues, or through a secure electronic environment accessible only by the educational establishment's pupils or students and teaching staff; and
(b) is accompanied by the indication of the source, including the author's name, unless this turns out to be impossible.
2. Notwithstanding Article 7(1), Member States may provide that the exception or limitation adopted pursuant to paragraph 1 does not apply or does not apply as regards specific uses or types of works or other subject matter, such as material that is primarily intended for the educational market or sheet music, to the extent that suitable licences authorising the acts referred to in paragraph 1 of this Article and covering the needs and specificities of educational establishments are easily available on the market.
Member States that decide to avail of the first subparagraph of this paragraph shall take the necessary measures to ensure that the licences authorising the acts referred to in paragraph 1 of this Article are available and visible in an appropriate manner for educational establishments.
3. The use of works and other subject matter for the sole purpose of illustration for teaching through secure electronic environments undertaken in compliance with the provisions of national law adopted pursuant to this Article shall be deemed to occur solely in the Member State where the educational establishment is established.
4. Member States may provide for fair compensation for rightholders for the use of their works or other subject matter pursuant to paragraph 1.

De lidstaten voorzien in een uitzondering op of beperking van de rechten bedoeld in artikel 5, onder a), b), d), en e), en artikel 7, lid 1, van Richtlijn 96/9/EG, de artikelen 2 en 3 van Richtlijn 2001/29/EG, artikel 4, lid 1, van Richtlijn 2009/24/EG en artikel 15, lid 1, van deze richtlijn om digitaal gebruik van werken en andere materialen dat uitsluitend dient voor illustratie bij het onderwijs, mogelijk te maken voor zover dit wordt gerechtvaardigd door het te bereiken niet-commerciële doel, op voorwaarde dat zulk gebruik:
a) plaatsvindt onder de verantwoordelijkheid van een onderwijsinstelling, in haar gebouwen of elders, of door middel van een beveiligde elektronische omgeving die alleen toegankelijk is voor de leerlingen of studenten en het onderwijzend personeel van de onderwijsinstelling, en
b) vergezeld gaat van de vermelding van de bron, waaronder de naam van de auteur, tenzij dit niet mogelijk blijkt.
2. Niettegenstaande artikel 7, lid 1, kunnen de lidstaten bepalen dat de op grond van lid 1 vastgestelde uitzondering of beperking niet van toepassing is, of niet van toepassing is met betrekking tot specifieke vormen van gebruik of soorten werken of andere materialen, zoals materialen die in de eerste plaats bedoeld zijn voor de onderwijsmarkt of bladmuziek, voor zover passende licenties die de in lid 1 van dit artikel beschreven handelingen toestaan en die afgestemd zijn op de behoeften en specifieke kenmerken van onderwijsinstellingen, vlot beschikbaar zijn op de markt.
De lidstaten die besluiten gebruik te maken van de eerste alinea van dit lid, nemen de nodige maatregelen om ervoor te zorgen dat de licenties voor de in lid 1 van dit artikel bedoelde handelingen op een passende wijze beschikbaar en zichtbaar zijn voor onderwijsinstellingen.
3. Het gebruik van werken en andere materialen dat uitsluitend dient voor illustratie bij het onderwijs via beveiligde elektronische omgevingen overeenkomstig de bepalingen van op grond van dit artikel vastgesteld nationaal recht, wordt geacht uitsluitend plaats te vinden in de lidstaat waar de onderwijsinstelling is gevestigd.
4. De lidstaten kunnen voorzien in een billijke vergoeding voor rechthebbenden voor het gebruik van hun werken of andere materialen op grond van lid 1.
