Article 55, paragraph 5, applies if the participation ends as from the time of the entry into force of Article I, part E, of the Small Pensions Value Transfer Act (Wet waardeoverdracht klein pensioen).
If the participation has ended before the time of entry into force of Article I, part E, of the Small Pension Value Transfer Act (Wet waardeoverdracht klein pensioen), the pension provider has the right to cause the pension entitlements of a former participant to lapse if, on the basis of the entitlement to old-age pension accrued up to the time of termination, the old-age pension benefit on an annual basis on the regular commencement date will not exceed € 2.– per year. The pension provider making use of the right referred to in the first sentence shall inform the former participants thereof.
Article 70a applies if the participation has ended or ends as of 1 January 2018.
If the participation has ended before 1 January 2018:
Article 70a is applicable if the conditions to be set by or pursuant to an Order in Council (algemene maatregel van bestuur) are met;
the exception contained in Article 71, paragraph 1, does not apply for the application of Article 70a; and
are Articles 104, paragraph 3, opening words and subparagraph (d), 115a, paragraph 3, opening words and subparagraph (f), and 115c, paragraph 9, opening words and subparagraph (a):
insofar as it concerns the total or partial transfer of the obligations of the pension fund, applicable to the policy of the pension fund with regard to the application of Article 70a; and
insofar as it concerns the assumption of obligations by the pension fund, not applicable to the assumption of obligations by the pension fund as a result of the application of Article 70a or Article 81a of the Compulsory Occupational Pension Scheme Act (Wet verplichte beroepspensioenregeling).
Paragraphs 3 and 4 apply mutatis mutandis if the accrual of pension has ended for reasons other than the termination of participation.
Artikel 55, vijfde lid, is van toepassing indien de deelneming eindigt vanaf het tijdstip van inwerkingtreding van artikel I, onderdeel E, van de Wet waardeoverdracht klein pensioen.
Indien de deelneming is geëindigd voor het tijdstip van inwerkingtreding van artikel I, onderdeel E, van de Wet waardeoverdracht klein pensioen heeft de pensioenuitvoerder het recht om pensioenaanspraken van een gewezen deelnemer te laten vervallen indien op basis van de tot het tijdstip van beëindiging opgebouwde aanspraak op ouderdomspensioen de uitkering van het ouderdomspensioen op jaarbasis op de reguliere ingangsdatum niet meer zal bedragen dan € 2,– per jaar. De pensioenuitvoerder die gebruik maakt van het recht, bedoeld in de eerste zin, informeert de gewezen deelnemers hierover.
Artikel 70a is van toepassing indien de deelneming is geëindigd of eindigt vanaf 1 januari 2018.
Indien de deelneming is geëindigd voor 1 januari 2018:
is artikel 70a van toepassing indien voldaan wordt aan bij of krachtens algemene maatregel van bestuur te stellen voorwaarden;
geldt de in artikel 71, eerste lid, opgenomen uitzondering voor de toepassing van artikel 70a niet; en
zijn de artikelen 104, derde lid, aanhef en onderdeel d, 115a, derde lid, aanhef en onderdeel f, en 115c, negende lid, aanhef en onderdeel a:
voor zover het betreft de gehele of gedeeltelijke overdracht van de verplichtingen van het pensioenfonds, van toepassing op het beleid van het pensioenfonds ten aanzien van de toepassing van artikel 70a; en
voor zover het betreft de overname van verplichtingen door het pensioenfonds, niet van toepassing bij de overname van verplichtingen door het pensioenfonds als gevolg van de toepassing van artikel 70a of artikel 81a van de Wet verplichte beroepspensioenregeling.
Het derde en vierde lid zijn van overeenkomstige toepassing indien de verwerving van pensioen is geëindigd om andere redenen dan beëindiging van de deelneming.
