Article 8.3

Entitled to exercise hunting rights in a hunting field are, exclusively of one another:
the owner of the land,
the holder of a right of ground lease (erfpacht) or the usufructuary of the land, unless the owner, upon the establishment of the right of ground lease or the right of usufruct, has reserved the hunting rights for themselves and unless the hunting rights had already been leased at the time of the establishment of the right of ground lease or the right of usufruct,
the lessee of the land, unless the lessor was not entitled to exercise the hunting rights at the time of entering into the lease agreement or has reserved the right to exercise the hunting rights for themselves, and unless the hunting rights had already been leased out at the time of entering into the lease agreement, or
the person who has leased the hunting right by means of a written and dated agreement for a period of at least six years and at most twelve years from the person who, at the time of entering into the lease agreement, was entitled to exercise the hunting right:
owner, long-term lessee (erfpachter), usufructuary or lessee of the land, with the consent of the land user if the lessor is not also the land user, or
lessee of the hunting right, with the consent of the owner, the holder of a right of long lease (erfpachter), the usufructuary or the lessee who has leased the hunting right to this lessee, and provided that the hunting right is subleased in its entirety.
In the lease agreement referred to in the first paragraph, under (d), no derogation may be made from Article 226, paragraphs one, two and three, of Book 7 of the Civil Code. It shall not contain any option or extension clause.
By Order in Council, it may be provided in which cases it is permitted that the period referred to in the first paragraph, under (d), is shorter than six years.
Hunting is permitted only for animals of the following species:
small game: pheasants (Phasianus colchicus), hares (Lepus Europaeus),
waterfowl: wild ducks (Anas platyrhynchos),
other game: wood pigeons (Columba palumbus), rabbits (Oryctolagus cuniculus).
Gerechtigd tot het uitoefenen van de jacht in een jachtveld zijn, elkaar uitsluitend:
de eigenaar van de grond,
de erfpachter of vruchtgebruiker van de grond, tenzij de eigenaar zich bij het vestigen van het erfpachtrecht of het recht op vruchtgebruik het jachtrecht heeft voorbehouden en tenzij het jachtrecht ten tijde van het vestigen van het erfpachtrecht of het recht op vruchtgebruik al was verhuurd,
de pachter van de grond, tenzij de verpachter bij het aangaan van de pachtovereenkomst niet tot het uitoefenen van de jacht gerechtigd was of zich het recht tot de uitoefening van de jacht heeft voorbehouden en tenzij ten tijde van het aangaan van de pachtovereenkomst het jachtrecht al was verhuurd, of
degene die het jachtrecht bij schriftelijke en gedagtekende overeenkomst voor een periode van ten minste zes jaar en ten hoogste twaalf jaar heeft gehuurd van de ten tijde van het aangaan van de huurovereenkomst tot de uitoefening van de jacht gerechtigde:
eigenaar, erfpachter, vruchtgebruiker of pachter van de grond, met toestemming van de grondgebruiker als de verhuurder niet ook grondgebruiker is, of
huurder van het jachtrecht, met toestemming van de eigenaar, erfpachter, vruchtgebruiker of pachter die het jachtrecht aan deze huurder heeft verhuurd en mits het jachtrecht in zijn geheel wordt weder verhuurd.
In de huurovereenkomst, bedoeld in het eerste lid, onder d, kan niet worden afgeweken van artikel 226, eerste, tweede en derde lid, van Boek 7 van het Burgerlijk Wetboek. Zij bevat geen beding van optie of verlenging.
Bij algemene maatregel van bestuur kan worden geregeld in welke gevallen het is toegestaan dat de periode, bedoeld in het eerste lid, onder d, korter is dan zes jaar.
De jacht is alleen toegestaan op dieren van de volgende soorten:
klein wild: fazanten (Phasianus colchicus), hazen (Lepus Europaeus),
waterwild: wilde eenden (Anas platyrhynchos),
overig wild: houtduiven (Columba palumbus), konijnen (Oryctolagus cuniculus).
