Article 2.33

The Provincial Executive may, with due observance of the limits of Article 2.3, paragraph 2, issue an instruction to the municipal council or the water board whose management area is situated entirely or largely within the province concerned regarding the exercise of a task or power.
An instruction can only be given to:
the municipal council regarding the setting of rules in an environmental plan as referred to in Article 4.2, paragraph 1, if necessary with a view to a balanced allocation of functions to locations,
the water board, if necessary for an efficient control of noise originating from roads as referred to in Article 2.17, first paragraph, under c,
the water board, if necessary for coherent and efficient regional water management,
the executive board of the water board regarding a project decision, if necessary with a view to a balanced allocation of functions to locations,
the municipal executive (college van burgemeester en wethouders) regarding the housing programme, as referred to in Article 3.6, paragraph 3, if necessary with a view to a balanced composition of the housing stock.
Article 2:23, paragraphs 2 and 4, shall apply mutatis mutandis to the giving of an instruction.
An instruction cannot be given if application can be made of:
Article 124, 124a or 273a of the Municipalities Act (Gemeentewet), or
Article 156, paragraph 1, of the Water Boards Act (Waterschapswet).
Gedeputeerde staten kunnen, met inachtneming van de grenzen van artikel 2.3, tweede lid, de gemeenteraad of het waterschapsbestuur waarvan het beheergebied geheel of grotendeels in de betrokken provincie is gelegen een instructie geven over de uitoefening van een taak of bevoegdheid.
Een instructie kan alleen worden gegeven aan:
de gemeenteraad over het stellen van regels in een omgevingsplan als bedoeld in artikel 4.2, eerste lid, als dat nodig is met het oog op een evenwichtige toedeling van functies aan locaties,
het waterschapsbestuur, als dat nodig is voor een doelmatige beheersing van het geluid afkomstig van wegen als bedoeld in artikel 2.17, eerste lid, onder c,
het waterschapsbestuur, als dat nodig is voor een samenhangend en doelmatig regionaal waterbeheer,
het dagelijks bestuur van het waterschap over een projectbesluit, als dat nodig is met het oog op een evenwichtige toedeling van functies aan locaties,
het college van burgemeester en wethouders over het volkshuisvestingsprogramma, bedoeld in artikel 3.6, derde lid, als dat nodig is met het oog op een evenwichtige samenstelling van de woningvoorraad.
Op het geven van een instructie is artikel 2.23, tweede en vierde lid, van overeenkomstige toepassing.
Een instructie kan niet worden gegeven als toepassing kan worden gegeven aan:
artikel 124, 124a of 273a van de Gemeentewet, of
artikel 156, eerste lid, van de Waterschapswet.
