The Provincial Executive (Gedeputeerde staten) may, if in their judgment a water board authority fails to act or does not act sufficiently in the event of a danger to water management works, issue an instruction to that authority as referred to in Article 2.33.
If this is necessary due to urgent circumstances, the King's Commissioner may issue that instruction, for as long as the danger persists and the provincial executive (gedeputeerde staten) does not exercise that power.
Article 2:36, paragraph 1, opening words and under a, applies to an instruction as referred to in the first and second paragraphs.
Our Minister of Infrastructure and Water Management may issue an instruction to the water board as referred to in Article 2.34 if, in his opinion:
the provincial executive (gedeputeerde staten) or the King's Commissioner (commissaris van de Koning) wrongfully fail to exercise, or do not sufficiently exercise, the authority referred to in the first or second paragraph, and
the water board authority fails to act or does not act sufficiently in the event of a danger to a primary flood defence structure.
Article 2:36, paragraph 2, preamble and under a, applies to an instruction as referred to in the fourth paragraph.
Gedeputeerde staten kunnen, als naar hun oordeel een waterschapsbestuur niet of niet voldoende optreedt bij gevaar voor waterstaatswerken, aan dat bestuur een instructie geven als bedoeld in artikel 2.33.
Als dit vanwege spoedeisende omstandigheden nodig is, kan de commissaris van de Koning die instructie geven, zolang het gevaar voortduurt en gedeputeerde staten van die bevoegdheid geen gebruik maken.
Op een instructie als bedoeld in het eerste en tweede lid is artikel 2.36, eerste lid, aanhef en onder a, van toepassing.
Onze Minister van Infrastructuur en Waterstaat kan aan het waterschapsbestuur een instructie geven als bedoeld in artikel 2.34 als naar zijn oordeel:
gedeputeerde staten of de commissaris van de Koning ten onrechte niet of niet voldoende gebruikmaken van de bevoegdheid, bedoeld in het eerste of tweede lid, en
het waterschapsbestuur niet of niet voldoende optreedt bij gevaar voor een primaire waterkering.
Op een instructie als bedoeld in het vierde lid is artikel 2.36, tweede lid, aanhef en onder a, van toepassing.
