Division 3.4 of the General Administrative Law Act applies to the preparation of a land consolidation decision.
The land consolidation decision shall specify how the owners and users were involved in the preparation of the draft land consolidation decision and what the results thereof are.
Simultaneously with the notification referred to in Article 3:12, paragraph 1, of the General Administrative Law Act, the provincial executive shall notify the interested parties known to them, including in any event, of the public inspection and the essential contents of the draft decision:
those who appear on the list of entitled persons, referred to in Article 12.22, which forms part of the draft decree,
those who, pursuant to Article 16:125, paragraph 1 or 2, have submitted a lease agreement for registration,
the other party, as referred to in Article 16:125, paragraph 4.
Afdeling 3.4 van de Algemene wet bestuursrecht is van toepassing op de voorbereiding van een ruilbesluit.
In het ruilbesluit wordt aangegeven hoe de eigenaren en gebruikers bij de voorbereiding van het ontwerp van het ruilbesluit zijn betrokken en wat de resultaten daarvan zijn.
Tegelijk met de kennisgeving, bedoeld in artikel 3:12, eerste lid, van de Algemene wet bestuursrecht, geven gedeputeerde staten kennis van de terinzagelegging en van de zakelijke inhoud van het ontwerpbesluit aan de bij hen bekende belanghebbenden, onder wie in ieder geval:
zij die voorkomen op de lijst van rechthebbenden, bedoeld in artikel 12.22, die deel uitmaakt van het ontwerpbesluit,
zij die op grond van artikel 16.125, eerste of tweede lid, een pachtovereenkomst ter registratie hebben ingezonden,
de wederpartij, bedoeld in artikel 16.125, vierde lid.
