If the municipal executive (college van burgemeester en wethouders) is the competent authority for the application for the environmental permit for the environmentally harmful activity, the provincial executive (gedeputeerde staten) may, if required for the protection of the environment due to the coherence between the decisions on both applications, issue an instruction to the municipal executive regarding the content of that decision, at the request of the competent authority for the application for the environmental permit for the water activity. Article 2.33 applies mutatis mutandis to the instruction, whereby a departure may be made from rules as referred to in Articles 2.22 and 2.23.
The instruction shall be given within eight weeks after the day on which the draft decision on the application for the environmental permit for the environmentally hazardous activity has been made available for public inspection and notice thereof has been given in accordance with Section 3:11, subsection 1, of the General Administrative Law Act.
Als het college van burgemeester en wethouders het bevoegd gezag is voor de aanvraag om de omgevingsvergunning voor de milieubelastende activiteit, kunnen gedeputeerde staten, als dat vanwege de samenhang tussen de beslissingen op de beide aanvragen met het oog op het beschermen van het milieu geboden is, aan het college van burgemeester en wethouders, op verzoek van het bevoegd gezag voor de aanvraag om de omgevingsvergunning voor de wateractiviteit, een instructie geven over de inhoud van die beslissing. Op de instructie is artikel 2.33 van overeenkomstige toepassing, waarbij kan worden afgeweken van regels als bedoeld in de artikelen 2.22 en 2.23.
De instructie wordt gegeven binnen acht weken na de dag waarop het ontwerpbesluit op de aanvraag om de omgevingsvergunning voor de milieubelastende activiteit overeenkomstig artikel 3:11, eerste lid, van de Algemene wet bestuursrecht ter inzage is gelegd en daarvan kennis is gegeven.
