A land consolidation in rural areas is a land consolidation agreement intended to improve an area in accordance with the functions assigned to the locations concerned.
The land consolidation agreement for land consolidation in rural areas does not apply to:
plots that form part of a spatially contiguous or functionally connected complex of plots:
which is in use for residential purposes, including recreational accommodation, non-agricultural business activities and socio-cultural facilities, urban green space and infrastructure,
where, on the basis of the functions assigned to the locations concerned, a use as referred to under 1° is possible,
for which, pursuant to a draft decision to establish an environmental plan or a project decision, a use as referred to under 1° will be made possible,
plots where excavation takes place, unless, in accordance with the regulations attached to the environmental permit for the excavation activity, they are made suitable for agricultural purposes, small-scale recreation, or the development of nature after the excavation, or
the limited rights with regard to the plots, referred to under (a) and (b).
A business relocation, in which the land of the vacated business is used to consolidate immovable property and to parcel out the given mass in a specific manner, may be included in a land consolidation agreement for land consolidation in rural areas.
Een kavelruil landelijk gebied is een kavelruilovereenkomst die strekt tot verbetering van een gebied in overeenstemming met de functies die aan de betrokken locaties zijn toegedeeld.
De kavelruilovereenkomst voor kavelruil landelijk gebied heeft geen betrekking op:
kavels die deel uitmaken van een ruimtelijk aaneengesloten of functioneel verbonden samenstel van kavels:
dat in gebruik is voor wonen, met inbegrip van verblijfsrecreatie, niet-agrarische bedrijvigheid en sociaal-culturele voorzieningen, stedelijk groen en infrastructuur,
waar op grond van de functies die aan de betrokken locaties zijn toegedeeld een gebruik als bedoeld onder 1° mogelijk is,
waarvoor volgens een ontwerpbesluit tot vaststelling van een omgevingsplan of een projectbesluit een gebruik als bedoeld onder 1° mogelijk zal worden gemaakt,
kavels waar ontgronding plaatsvindt, tenzij die volgens de voorschriften die zijn verbonden aan de omgevingsvergunning voor de ontgrondingsactiviteit na de ontgronding geschikt worden gemaakt voor landbouwdoeleinden, kleinschalige recreatie of de ontwikkeling van natuur, of
de beperkte rechten met betrekking tot de kavels, bedoeld onder a en b.
Een bedrijfsverplaatsing, waarbij de gronden van het achtergelaten bedrijf worden gebruikt om onroerende zaken samen te voegen en de gegeven massa op een bepaalde wijze te verkavelen, kan worden opgenomen in een kavelruilovereenkomst voor kavelruil landelijk gebied.
