Article 134a
in forceEFFECTS OF THE EUROPEAN PATENT AND OF THE EUROPEAN PATENT APPLICATION
The Administrative Council shall be competent to adopt and amend provisions governing:
the Institute of Professional Representatives before the European Patent Office, hereinafter referred to as the Institute;
the qualifications and training required of a person for admission to the European qualifying examination and the conduct of such examination;
the disciplinary power exercised by the Institute or the European Patent Office in respect of professional representatives;
the obligation of confidentiality on the professional representative and the privilege from disclosure in proceedings before the European Patent Office in respect of communications between a professional representative and his client or any other person.
Any person entered on the list of professional representatives referred to in Article 134, paragraph 1, shall be a member of the Institute.
De Raad van Bestuur is bevoegd bepalingen vast te stellen en te wijzigen ten aanzien van:
het Instituut van erkende gemachtigden voor het Europees Octrooibureau, hierna te noemen het Instituut;
de vereiste bekwaamheid en opleiding om te worden toegelaten tot het Europese bekwaamheidsexamen en ten aanzien van het afnemen van dit examen;
het tuchtrechtelijk toezicht dat het Instituut of het Europees Octrooibureau over de erkende gemachtigden uitoefent;
de geheimhoudingsverplichting van de erkend gemachtigde en het recht in procedures voor het Europees Octrooibureau te weigeren communicatie tussen een erkend gemachtigde en zijn cliënt of enig andere persoon bekend te maken.
Iedere persoon die ingeschreven staat op de lijst van erkende gemachtigden bedoeld in artikel 134, eerste lid, is lid van het Instituut.
