Within nine months of the publication of the mention of the grant of the European patent in the European Patent Bulletin, any person may give notice to the European Patent Office of opposition to that patent, in accordance with the Implementing Regulations. Notice of opposition shall not be deemed to have been filed until the opposition fee has been paid.
The opposition shall apply to the European patent in all the Contracting States in which that patent has effect.
Opponents shall be parties to the opposition proceedings as well as the proprietor of the patent.
Where a person provides evidence that in a Contracting State, following a final decision, he has been entered in the patent register of such State instead of the previous proprietor, such person shall, at his request, replace the previous proprietor in respect of such State. Notwithstanding Article 118, the previous proprietor and the person making the request shall not be regarded as joint proprietors unless both so request.
Binnen negen maanden na de datum waarop de vermelding van de verlening van het Europees octrooi is gepubliceerd in het Europees Octrooiblad, kan een ieder bij het Europees Octrooibureau oppositie instellen tegen dat octrooi, in overeenstemming met het Uitvoeringsreglement. De oppositie wordt eerst geacht te zijn ingesteld nadat de taks voor de oppositie is betaald.
De oppositie geldt voor het Europees octrooi in alle Verdragsluitende Staten waarin het werking heeft.
De opposanten zijn, evenals de octrooihouder, partij in de oppositieprocedure.
Indien iemand bewijst dat hij in plaats van de vorige octrooihouder, op grond van een in kracht van gewijsde gegaan vonnis, in een Verdragsluitende Staat is ingeschreven in het octrooiregister, treedt hij, op zijn verzoek, voor deze Staat in de plaats van de vorige octrooihouder. Niettegenstaande het bepaalde in artikel 118 worden de vorige octrooihouder en de persoon die het verzoek heeft gedaan, niet beschouwd als medehouders, tenzij beiden hierom verzoeken.
