If the opposition is admissible, the Opposition Division shall examine, in accordance with the Implementing Regulations, whether at least one ground for opposition under Article 100 prejudices the maintenance of the European patent. During this examination, the Opposition Division shall invite the parties, as often as necessary, to file observations on communications from another party or issued by itself.
If the Opposition Division is of the opinion that at least one ground for opposition prejudices the maintenance of the European patent, it shall revoke the patent. Otherwise, it shall reject the opposition.
If the Opposition Division is of the opinion that, taking into consideration the amendments made by the proprietor of the European patent during the opposition proceedings, the patent and the invention to which it relates
meet the requirements of this Convention, it shall decide to maintain the patent as amended, provided that the conditions laid down in the Implementing Regulations are fulfilled;
do not meet the requirements of this Convention, it shall revoke the patent.
Indien de opposant ontvankelijk is, onderzoekt de oppositieafdeling, in overeenstemming met het Uitvoeringsreglement, of ten minste een van de in artikel 100 genoemde gronden voor oppositie zich verzet tegen het in stand blijven van het Europees octrooi. Tijdens dit onderzoek verzoekt de oppositieafdeling zo dikwijls als nodig partijen te reageren op mededelingen die zij tot hen heeft gericht of op mededelingen van andere partijen.
Indien de oppositieafdeling van oordeel is dat ten minste een grond voor oppositie zich verzet tegen het in stand blijven van het Europees octrooi, herroept zij het octrooi. Is dat niet het geval dan wijst zij de oppositie af.
Indien de oppositieafdeling van oordeel is dat, gelet op de wijzigingen die de houder van het Europees octrooi tijdens de oppositieprocedure heeft aangebracht, het octrooi en de uitvinding waarop het octrooi betrekking heeft
voldoen aan de vereisten van dit Verdrag, beslist zij het octrooi in de gewijzigde vorm in stand te houden, mits voldaan wordt aan de voorwaarden vastgesteld in het Uitvoeringsreglement;
niet voldoen aan de vereisten van dit Verdrag, herroept zij het octrooi.
