If the agreement grants the buyer the power to specify the item by designating the size or shape or in another manner, and he is in default thereof, the seller may proceed to do so himself, taking into account the needs of the buyer known to him.
Indien de overeenkomst aan de koper de bevoegdheid geeft door aanwijzing van maat of vorm of op andere wijze de zaak te specificeren en hij daarmede in verzuim is, kan de verkoper daartoe zelf overgaan, met inachtneming van de hem bekende behoeften van de koper.
