The right of action for damages of the injured party against the producer pursuant to Article 185, paragraph 1, shall prescribe by the lapse of three years from the commencement of the day following that on which the injured party became aware, or ought to have become aware, of the damage, the defect, and the identity of the producer.
The right to compensation of the injured party against the producer pursuant to Article 185, paragraph 1, shall lapse after the expiry of ten years from the beginning of the day following that on which the producer put into circulation the product which caused the damage. The same shall apply to the right of a third party who is jointly liable for the damage in respect of recourse against the producer.
De rechtsvordering tot schadevergoeding van de benadeelde tegen de producent ingevolge artikel 185, eerste lid, verjaart door verloop van drie jaren na de aanvang van de dag, volgende op die waarop de benadeelde met de schade, het gebrek en de identiteit van de producent bekend is geworden of had moeten worden.
Het recht op schadevergoeding van de benadeelde jegens de producent ingevolge artikel 185, eerste lid, vervalt door verloop van tien jaren na de aanvang van de dag, volgende op die waarop de producent de zaak die de schade heeft veroorzaakt, in het verkeer heeft gebracht. Hetzelfde geldt voor het recht van een derde die mede voor de schade aansprakelijk is, terzake van regres jegens de producent.
