If the administration has been instituted in the interest of the person entitled, the latter shall only be authorised, with the cooperation or consent of the administrator, to perform acts other than those referred to in the preceding Article which directly concern an asset under administration. The same applies to the powers of a usufructuary with respect to the assets subject to a usufruct placed under administration and which extend beyond the use thereof.
If the administration (bewind) has been established in the interest of a person other than the person entitled (rechthebbende) or in a common interest, the person entitled is only authorised to perform an act as referred to in paragraph 1 subject to the administration.
If the administration has been instituted both in the interest of the person entitled and in the interest of one or more others or in a common interest, the person entitled shall only be authorised to perform an act as referred to in paragraph 1 with the cooperation or consent of the administrator and subject to that administration.
Indien het bewind is ingesteld in het belang van de rechthebbende, is deze slechts met medewerking of toestemming van de bewindvoerder bevoegd tot andere handelingen dan die in het vorige artikel bedoeld, welke een onder bewind staand goed rechtstreeks betreffen. Hetzelfde geldt voor de bevoegdheden van een vruchtgebruiker met betrekking tot de goederen waarop onder bewind gesteld vruchtgebruik rust en die verder gaan dan het gebruik daarvan.
Indien het bewind is ingesteld in het belang van een ander dan de rechthebbende of in een gemeenschappelijk belang, is de rechthebbende slechts onder voorbehoud van het bewind bevoegd tot het verrichten van een handeling als bedoeld in lid 1.
Indien het bewind zowel in het belang van de rechthebbende als van een of meer anderen of in een gemeenschappelijk belang is ingesteld, dan is de rechthebbende slechts met medewerking of toestemming van de bewindvoerder en onder voorbehoud van dat bewind bevoegd tot het verrichten van een handeling als bedoeld in lid 1.
