The court may, if it appears to it that a minor of twelve years of age or older so desires, ex officio give a decision pursuant to Articles 377a or 377b, or modify such a decision pursuant to Article 377e of this Book. The same applies if the minor has not yet reached the age of twelve years, but can be deemed capable of a reasonable assessment of his interests in the matter.
De rechter kan, indien haar blijkt dat de minderjarige van twaalf jaar of ouder hierop prijs stelt, ambtshalve een beslissing geven op de voet van de artikelen 377a of 377b, dan wel zodanige beslissing op de voet van artikel 377e van dit boek wijzigen. Hetzelfde geldt indien de minderjarige de leeftijd van twaalf jaren nog niet heeft bereikt, maar in staat kan worden geacht tot een redelijke waardering van zijn belangen ter zake.

Brother not an interested party in the decision of the children's court judge regarding the out-of-home placement of his brothers and sisters. Authority is exercised over each minor child individually, and the statutory criteria for the application of this measure must be met for each child separately. In the case of each individual minor child, therefore, only the rights and obligations arising from the authority over this child, pertaining to this child and the parents exercising authority over this child or the foster parents, are involved. This is not altered by the fact that a decision for out-of-home placement also affects the right of the other minor children to the protection of their family life with the child concerned, as guaranteed by Article 8 ECHR.
