In addition to the grounds for refusal provided for in Article 2.2bis, with the exception of Article 2.2bis, paragraph 1, under c, regarding signs or indications which may serve in trade to designate the geographical origin of the goods or services, an application for a collective mark shall be refused if the provisions of Article 2.34bis or 2.34ter have not been complied with or if the regulations governing that collective mark are contrary to public policy or accepted principles of morality.
An application for a collective mark shall also be refused where the public is liable to be misled as regards the nature or significance of the mark, in particular if it is likely to give the impression that it is something other than a collective mark.
The application shall not be refused if, due to an amendment of the regulations for that collective mark, the applicant complies with the requirements set out in paragraphs 1 and 2.
Naast de in artikel 2.2bis bepaalde weigeringsgronden, met uitzondering van artikel 2.2bis, lid 1, sub c, met betrekking tot tekens of benamingen die in de handel tot aanduiding van de plaats van herkomst van de waren of diensten kunnen dienen, wordt een aanvraag om een collectief merk afgewezen indien niet is voldaan aan de bepalingen van artikel 2.34bis of 2.34ter of indien het reglement voor dat collectief merk strijdig is met de openbare orde of de goede zeden.
Een aanvraag om een collectief merk wordt eveneens afgewezen wanneer het publiek kan worden misleid inzake de aard of betekenis van het merk, met name wanneer het de indruk kan wekken iets anders te zijn dan een collectief merk.
De aanvraag wordt niet afgewezen wanneer de aanvrager door een wijziging van het reglement voor dat collectief merk voldoet aan de in de leden 1 en 2 gestelde eisen.
