The claim to a right of priority resulting from the Paris Convention or the TRIPS Agreement shall be made at the time of the application.
The right of priority as referred to in Article 4 of the Paris Convention shall likewise apply to service marks.
A claim to a right of priority may also be made by submitting a special declaration to the Office, in the month following the application, in compliance with the formal requirements laid down by implementing regulations and upon payment of the fees due.
The absence of such an appeal shall cause the right of priority to lapse.
Het beroep op een recht van voorrang voortvloeiend uit het Verdrag van Parijs of het TRIPS verdrag wordt gedaan bij de aanvraag.
Het recht van voorrang als bedoeld in artikel 4 van het Verdrag van Parijs is eveneens van toepassing op dienstmerken.
Het beroep op een recht van voorrang kan tevens worden gedaan door een bijzondere verklaring af te leggen bij het Bureau, in de maand volgende op de aanvraag, met inachtneming van de bij uitvoeringsreglement gestelde vormvereisten en tegen betaling van de verschuldigde taksen.
Het ontbreken van een dergelijk beroep doet het recht op voorrang vervallen.
