Without prejudice to Article 68, paragraphs 1 and 2, of the Procedural Regulation, the operation of the decision concerning a residence permit for asylum as referred to in Article 28 shall be suspended until the period for lodging an appeal has expired or, if an appeal has been lodged, the appeal has been decided upon.
Paragraph 1 shall not apply if:
Article 68, paragraph 3, of the Procedural Regulation is applicable;
Article 43, paragraph 3, of the Asylum and Migration Management Regulation is applicable;
it concerns a decision as referred to in Article 43 or 45, paragraph 4.
By or pursuant to an Order in Council (algemene maatregel van bestuur), further rules may be established regarding the right to reside in the Netherlands, whether or not pending the decision on a petition for a provisional measure.
Onverminderd artikel 68, eerste en tweede lid, van de Procedureverordening, wordt de werking van het besluit omtrent een verblijfsvergunning asiel als bedoeld in artikel 28 opgeschort totdat de beroepstermijn is verstreken of, indien beroep is ingesteld, op het beroep is beslist.
Het eerste lid is niet van toepassing, indien:
artikel 68, derde lid, van de Procedureverordening van toepassing is;
artikel 43, derde lid, van de Asiel- en migratiebeheerverordening van toepassing is;
het een besluit als bedoeld in artikel 43 of 45, vierde lid, betreft.
Bij of krachtens algemene maatregel van bestuur kunnen nadere regels worden gesteld omtrent het recht om al dan niet in afwachting van de uitspraak op een verzoek om een voorlopige voorziening in Nederland te mogen verblijven.

By decision of 7 February 2025, the Minister of Asylum and Migration has placed the appellant in administrative detention.

This ruling concerns the question of whether a provisional measure granted by the Division at the request of the State Secretary can suspend the Dublin transfer period of six months. The answer to that question is of importance for answering the question of which Member State is responsible for the substantive consideration of the asylum application. And therefore for the question of whether the State Secretary correctly did not take into consideration the application of the foreign national to be granted a fixed-term asylum residence permit.
