If there is a case of commercial communication, including advertising or marketing, the information mentioned by or pursuant to the following articles is in any event essential as referred to in Article 193d paragraph 2:
Article 15d paragraphs 1 and 2 and Article 15e paragraph 1 of Book 3;
Articles 230m paragraph 1, subparagraphs a, b and c, e up to and including h, o and p and 230v, paragraphs 1 up to and including 3, 5, as well as paragraph 6, first sentence, and paragraph 7, of Book 6;
Article 502 paragraphs 1 to 3 inclusive of Book 7;
Articles 73 up to and including 75 of the Medicines Act (Geneesmiddelenwet);
Articles 4:20 and 4:25b of the Financial Supervision Act (Wet op het financieel toezicht);
Article 2b of the Prices Act;
Article 6 of Regulation (EU) 2017/1129 of the European Parliament and of the Council of 14 June 2017 on the prospectus to be published when securities are offered to the public or admitted to trading on a regulated market, and repealing Directive 2003/71/EC (OJ EU 2017, L 168).
Indien er sprake is van commerciële communicatie, reclame of marketing daaronder begrepen, is de informatie genoemd bij of krachtens de volgende artikelen in ieder geval essentieel als bedoeld in artikel 193d lid 2:
artikel 15d leden 1 en 2 en artikel 15e lid 1 van Boek 3;
artikelen 230m lid 1, onderdelen a, b en c, e tot en met h, o en p en 230v, leden 1 tot en met 3, 5, alsmede lid 6, eerste zin, en lid 7, van Boek 6;
artikel 502 leden 1 tot en met 3 van Boek 7;
artikelen 73 tot en met 75 van de Geneesmiddelenwet;
artikelen 4:20 en 4:25b van de Wet op het financieel toezicht;
artikel 2b van de Prijzenwet;
artikel 6 van Verordening (EU) nr. 2017/1129 van het Europees Parlement en de Raad van de Europese Unie van 14 juni 2017 betreffende het prospectus dat moet worden gepubliceerd wanneer effecten aan het publiek worden aangeboden of tot de handel op een gereglementeerde markt worden toegelaten en tot intrekking van Richtlijn 2003/71/EG (PbEU 2017, L 168).
