If the fulfillment of a suspensive condition attached to a testamentary obligation is prevented by the person upon whom the obligation rests, the condition shall be deemed to have been fulfilled if reasonableness and fairness so require.
If the fulfillment of a resolutive condition attached to a testamentary obligation has been brought about by the person upon whom the obligation rests, the condition shall be deemed not to have been fulfilled if reasonableness and fairness so require.
Article 140 paragraph 1 shall apply mutatis mutandis.
Is de vervulling van een aan een testamentaire last toegevoegde opschortende voorwaarde belet door degene op wie de last rust, dan geldt de voorwaarde als vervuld, indien de redelijkheid en billijkheid dit verlangen.
Is de vervulling van een aan een testamentaire last toegevoegde ontbindende voorwaarde teweeggebracht door degene op wie de last rust, dan geldt de voorwaarde als niet vervuld, indien de redelijkheid en billijkheid dit verlangen.
Artikel 140 lid 1 is van overeenkomstige toepassing.
