14.1 Policy rules for the principal person
The IND shall, on the basis of Article 3.48, second paragraph, opening words and under (b), of the Aliens Decree (Vreemdelingenbesluit) in conjunction with Article 3.24aa, first paragraph, opening words and under (g), of the Aliens Regulation (Voorschrift Vreemdelingen), grant a fixed-term ordinary residence permit to protected witnesses who have been admitted to the protection programme of the National Unit of the Police if a petition to that effect has been submitted by the Public Prosecutor responsible for witness protection and special witnesses of the National Unit.
14.2 Policy rules for the family members of the principal person
The IND grants the residence permit regular for a fixed period on the basis of Article 3.48, second paragraph under b, of the Aliens Decree (Vreemdelingenbesluit) in conjunction with Article 3.24aa, first paragraph, opening words and under g, of the Aliens Regulation (Voorschrift Vreemdelingen), to the (adoptive or foster) children, parents, spouse (echtgenoot) or partner who de facto belong to the family of the principal person.
The main person must demonstrate that his (adoptive or foster) children, parents, spouse (echtgenoot) or partner factually belonged to his family at the time of the main person's entry into the Netherlands and that said factual family tie has not been severed.
14.3 Exemption from the Provisional Residence Permit (MVV-vrijstelling)
The protected witness included in the protection programme of the National Unit of the Police and his family members shall be exempted from the mvv-requirement on the basis of the hardship clause (Article 3.71, third paragraph, Vb), if he qualifies for a residence permit on the basis of Article 3.48, second paragraph, opening words and under (b), Vb and Article 3.24aa, first paragraph, opening words and under (g), VV.
14.4 Restriction, labour market endorsement and period of validity
Pursuant to Article 3.4, paragraph 1, opening words and under (q) of the Aliens Decree (Vreemdelingenbesluit), the IND grants the residence permit under the restriction: ‘temporary humanitarian grounds’.

Pursuant to Article 3.1, paragraph 5, opening words and under (a) of the Aliens Regulation (Voorschrift Vreemdelingen), the labour market endorsement on the residence document shall read: ‘Labour freely permitted. TWV not required’.
Period of validity
Pursuant to Article 3.58, paragraph 1, opening words and under (q) of the Aliens Decree (Vreemdelingenbesluit), the IND shall grant a regular fixed-term residence permit on the basis of the policy concerning protected witnesses in the protection programme of the National Police (Politie Landelijke) with a period of validity of no more than one year.
Extension
The IND shall not extend the period of validity of the fixed-term ordinary residence permit on the grounds of Protected witness in the protection programme of the Police National Unit (Politie Landelijke Eenheid) pursuant to Article 3.48, paragraph 2, opening words and under (b), of the Aliens Decree (Vreemdelingenbesluit).
The foreigner may:
submit an application after six months for a fixed-term regular residence permit under the restriction ‘non-temporary humanitarian grounds’ (see paragraph B9 Vc).
Withdrawal
Upon termination of the protection programme, the IND shall, in principle, revoke the residence permit. If, in the interim, it appears that the foreign national concerned no longer satisfies one of the conditions attached to the right of residence, the IND shall assess whether this constitutes grounds for terminating the right of residence.
14.1 Beleidsregels voor de hoofdpersoon
De IND verleent op grond van artikel 3.48, tweede lid, aanhef en onder b, Vb jo artikel 3.24aa, eerste lid, aanhef en onder g VV, een verblijfsvergunning regulier voor bepaalde tijd aan beschermde getuigen die in het beschermingsprogramma van de Politie Landelijke Eenheid zijn opgenomen als er een daartoe strekkend verzoek is gedaan door de Officier van Justitie belast met getuigenbescherming en bijzondere getuigen van de Landelijke Eenheid.
14.2 Beleidsregels voor de gezinsleden van de hoofdpersoon
De IND verleent de verblijfsvergunning regulier voor bepaalde tijd op grond van artikel 3.48, tweede lid onder b, Vb jo artikel 3.24aa, eerste lid, aanhef en onder g, VV, aan de (adoptie- of pleeg) kinderen, ouders, echtgeno(o)t(e) of partner die feitelijk behoren tot het gezin van de hoofdpersoon.
De hoofdpersoon moet aantonen dat zijn (adoptie- of pleeg)kinderen, ouders, echtgeno(o)t(e) of partner op het moment van binnenkomst van de hoofdpersoon in Nederland feitelijk tot zijn gezin behoren en dat die feitelijke gezinsband niet verbroken is.
14.3 MVV-vrijstelling
De beschermde getuige opgenomen in beschermingsprogramma van de Politie Landelijke Eenheid en zijn gezinsleden worden vrijgesteld van het mvv-vereiste op grond van de hardheidsclausule (artikel 3.71, derde lid, Vb), als hij in aanmerking komt voor een verblijfsvergunning op grond van 3.48, tweede lid, aanhef en onder b, Vb en artikel 3.24aa, eerste lid, aanhef en onder g, VV.
14.4 Beperking, arbeidsmarktaantekening en geldigheidsduur
Op grond van artikel 3.4, eerste lid, aanhef en onder q, Vb verleent de IND de verblijfsvergunning onder de beperking: ‘tijdelijke humanitaire gronden’.
Arbeidsmarktaantekening
Op grond van artikel 3.1, vijfde lid, aanhef en onder a, VV luidt de arbeidsmarktaantekening op het verblijfsdocument: ‘Arbeid vrij toegestaan. TWV niet vereist’.
Geldigheidsduur
Op grond van artikel 3.58, eerste lid, aanhef en onder q, Vb, verleent de IND de verblijfsvergunning regulier voor bepaalde tijd op grond van het beleid inzake beschermde getuige in beschermingsprogramma van de Politie Landelijke met een geldigheidsduur van ten hoogste één jaar.
Verlenging
De IND verlengt de geldigheidsduur van de verblijfsvergunning regulier voor bepaalde tijd op grond van Beschermde getuige in beschermingsprogramma van de Politie Landelijke Eenheid artikel 3.48, tweede lid, aanhef en onder b, Vb niet.
De vreemdeling kan:
na zes maanden een aanvraag indienen voor een verblijfsvergunning regulier voor bepaalde tijd onder de beperking ‘niet-tijdelijke humanitaire gronden’ (zie paragraaf B9 Vc).
Intrekking
Bij beëindiging van het beschermingsprogramma zal de IND de verblijfsvergunning in beginsel intrekken. Als tussentijds blijkt dat de betreffende vreemdeling niet langer voldoet aan één van de voorwaarden die aan het verblijfsrecht is verbonden, beoordeelt de IND of dit aanleiding is het verblijfsrecht te beëindigen.
